ELIGIBILITY: The GoFundMe Heroes Celebration (“Event”), on November 14, 2019, is open only to legal residents of the 50 United States and the District of Columbia who are 13 years of age or older, provided however that if the entrant is a minor in their jurisdiction, then entrant represents and warrants that he/she only enters with the express consent of his/her parent or legal guardian. Employees and directors of GoFundMe, Inc. and GoFundMe.org (collectively “Sponsor”) or any of its parents, subsidiaries and affiliates, advertising, promotion, or production agencies (and their respective IRS dependents, immediate family members and individuals residing in their same household) (collectively, the “Event Entities”) are not eligible to participate. Void where prohibited by law. All applicable federal, state and local laws apply.

NOMINATION PERIOD: The nomination period begins on 05/14/2019 at 6:00:01 a.m. Pacific Time (“PT”), and ends on 06/14/2019 at 11:59:59 p.m. PT (the “Nomination Period”). the database computer of GoFundMe, Inc. is the official time-keeping device for the Nomination Period and Event.

HOW TO ENTER: During the Nomination Period, your campaign, which campaign supports a charitable purpose, will be nominated by a member of the public (“Public Nominations”). After the Nomination Period has ended, Sponsor shall select campaigns from the Public Nominations using the criteria set forth below (“Potential Finalists”). Sponsor shall, in its discretion, seek further information from the person identified as the Campaign Organizer of the Potential Finalists, with on-screen instructions to complete the entry form and submit his/her story as to why Campaign Organizer should be identified as a GoFundMe Hero (“Submission”). Moreover, Sponsor will reach out to Campaign Organizer to conduct an interview by telephone.

All Submissions must, as determined in Sponsor’s sole and absolute discretion: (a) be the exclusive original work of the entrant; (b) be in keeping with the Sponsor’s image, (c) not defame or invade publicity rights or privacy of any person, living or deceased, or otherwise infringe upon the rights of any person or entity, including but not limited to copyright, trademark, privacy or publicity, (d) not contain any commercial/corporate advertising, including but not limited to corporate logos, brand names, and slogans, other than Sponsor’s, in a manner that could be deemed infringing; (e) not depict any conduct or content that is unsafe, immoral, obscene or otherwise inappropriate; and (f) not violate Sponsor’s terms and conditions. Each entrant further represents and warrants that it has permission from any and all recognizable persons depicted in a Submission and agrees, upon request, to furnish written proof of such permission. Failure to meet any of the requirements above, or to otherwise comply with these Official Rules, may result in disqualification of the Submission by Sponsor in its sole and absolute discretion.

PUBLICITY/USAGE RIGHTS: By making a Submission, Campaign Organizer warrants and represents that he/she is the Campaign Organizer of the Campaign selected, that the Submission has been created by Campaign Organizer as an original work and that all required third-party releases (if any) have been obtained in writing, and Campaign Organizer further agrees and acknowledges that Sponsor (and those acting with its authorization) may copy, reproduce, edit, broadcast and otherwise use the Submission in any way in any medium whether now existing or later discovered, worldwide, in perpetuity, including but not limited to posting online on Sponsor’s social media pages, without consideration to Campaign Organizer or anybody associated with the Campaign. Sponsor reserves the right to delete or remove any inappropriate content from a Submission without disqualifying the entry where, in Sponsor’s determination, such change does not materially alter the Submission and the entrant has otherwise attempted in good faith to comply with these Official Rules. Campaign Organizer agrees to irrevocably assign and transfer to the Sponsor any and all rights, title and interest in his/her Submission including, without limitation, all copyrights and waive all moral rights.

By making a Submission, Campaign Organizer warrants and represents that (i) all statements made in the submission process are true, accurate, and complete; (ii) the Submission has not been and will not be assigned or transferred to another party; (iii) no licenses to the Submission has or will be granted; (iv) the Submission is and will remain from any and all other encumbrances of whatever kind or nature; (v) the Submission is unique to Campaign Organizer and was created solely by Campaign Organizer and no one else has any right, title, or interest in and to the submission and its contents (other than any co-submitters); and (vi) nothing in your Submission infringes or violates any patent, trademark, copyright, trade secret, or other right of any other party.

Except where prohibited, by the Submission constitutes Potential Finalists’ consent for use of Campaign Organizer’s name, likeness, voice, opinions, statements, biographical information, and/or hometown and state for promotional or advertising purposes in any media, worldwide, now known or hereafter developed, in perpetuity, without further review, notification, payment, or consideration (unless prohibited by law).

SELECTION OF POTENTIAL FINALISTS: All Public Nominations received during the Nomination Period will be evaluated by judges using the following criteria: (a) charitable purpose; (b) impact on charitable class; (c) expression of charitable purpose; (d) no allegations of fraud or misappropriation received by Sponsor for the Public Nominee or its Campaign Organizer; and (e) public appeal. The judges will comprise of Sponsor’s employees, officers or directors, to be determined by Sponsor in its sole and absolute discretion. Judges’ decisions are final and binding on all matters relating to the Event.

POTENTIAL FINALIST NOTIFICATION: Potential Finalists will be notified using the contact information provided in the Campaigns starting on or about 07/01/2019. No liability is assumed for any notification that is lost, intercepted or not received by a potential finalist for any reason. Failure to respond to any notification within three (3) business days may result in disqualification and selection of an alternate finalist. If a Potential Finalist fails to comply with Sponsor’s requests for further information, is found to be ineligible, or cannot or does not comply with these Official Rules, or no Submission is made or if Potential Finalist does not submit to a telephonic interview with Sponsor, then the Potential Finalist may be disqualified in Sponsor’s sole and absolute discretion.

SELECTION OF FINALISTS: The judges will evaluate the Submissions and the results of the telephone interview using the following criteria: (a) charitable purpose; (b) impact on charitable class; (c) expression of charitable purpose; (d) creativity of Submission; and (e) public appeal. During the evaluation process, the judges may reach out and speak with the Campaign Organizers as necessary for further information. Five (5) Finalists will be selected by the judges for the Prize. Once selected, the Five Finalists will be required to agree to work with Sponsor on a video to support their respective causes, and execute Affidavits of Eligibility, Liability Releases, agreement of confidentiality, and Publicity Releases (where legal) (“Prize Claim Documents”). If a Finalist fails to return the Prize Claim Documents (completed and legible), to comply with Sponsor’s requests for further information, or if Finalist is found to be ineligible, or cannot or does not comply with these Official Rules, then the Finalist may be disqualified in Sponsor’s sole and absolute discretion, and the judges may select an alternate. The Finalists will be selected by Sponsor and notified starting on or about July 16, 2019, with Sponsor disclosing the Finalists to the public on or about November 14, 2019.

PRIZE: There will be five (5) Finalists who will receive a 2-night trip to San Francisco, California, for Finalist and one (1) guest (which guest signs the Prize Claim Documents) to the Event on November 14, 2019, at a place to be announced. The trip includes (a) round trip coach class airfare from a major airline hub near Finalists’ residence to San Francisco International Airport (“SFO”) for two (2) people; (b) a two (2) night stay at a hotel (one standard room, double occupancy) in San Francisco, CA (hotel to be determined by Sponsor); (c) two (2) tickets for the Event; (d) standard round trip transportation from Finalists’ residence to closest major airline hub; (e) standard round trip transportation from SFO to the hotel; and (f) round trip transportation from hotel to Event. If a Finalist resides or is traveling from within a 100-mile radius of San Francisco, California, neither Finalist nor guest will receive air transportation. Instead, said Finalist and guest will receive a travel stipend of $100. The total approximate retail value (“ARV”) is $10,500.

Round-trip coach air transportation only for Finalists and one (1) guest each is provided by airlines of Sponsor or its representative’s choice from major hubs near each Finalist’s primary residence. Finalists and their guests must book travel through the assistance of Sponsor or its representative at least three (3) weeks in advance of departure, unless stated otherwise by Sponsor or its representative. Travel is subject to availability. Blackout dates may apply and this is determined at the sole and absolute discretion of Sponsor or its representative. Certain additional restrictions may apply. Travel must be used in conjunction with the rest of the Prize. A Finalist and his/her guest must travel on the same itinerary. Sponsor will not replace any lost or stolen tickets, travel vouchers, or certificates. Finalists’ use of the airline tickets or any other tickets is subject to the terms and conditions set forth thereon or governing its use. Once booked, no change, extension, or substitution of travel dates is permitted, except by Sponsor at its sole and absolute discretion. All tickets are non-refundable and not redeemable for cash or credit. Tickets may not be transferred or sold to a third party. Tickets may not be upgraded, even if with miles or redeemed for miles. Finalists and their respective guests are responsible for obtaining all necessary and required travel documentation, authorizations, and travel and health insurance.

The hotel (one standard room, double occupancy) will be selected by the Sponsor or its representative, in its sole and absolute discretion. Accommodations are subject to change based on availability and blackout dates. The exact dates and times of hotel stay to be specified by Sponsor or its representative, and all such details will be communicated to the Finalists at a later date. Finalists must stay in the hotel on the exact dates and times and itinerary specified by Sponsor or its representative. Accommodations must be made through Sponsor or its representative. Finalists and guest must comply with all hotel check-in requirements, including, but not limited to, the presentation of a payment card. Finalists will be required to provide a credit card to the hotel at the time they arrive for incidentals and other charges not expressly stated herein.

Event attendance is required by the Finalists and their respective guests. All attendees are subject to the rules or policy of the Event venue. Sponsor reserves the right to revoke full or partial prize from any Finalists or their guest who Sponsor or venue personnel deem may be intoxicated, by a safety risk, have violated the law or any venue policy or rule, and/or may bring Sponsor into disrepute. Any person acting in violation of these Official Rules or is otherwise acting in a manner that is deemed disruptive at any time may forfeit the Prize or be ejected by Sponsor in its sole and absolute discretion.

Prize is non-transferable and no cash equivalent or substitution of the prize is offered, except at the sole discretion of the Sponsor. Sponsor may substitute a prize of comparable value if advertised prize becomes unavailable. If for any reason any portion of the prize does not occur, such portion will be forfeited with no compensation being paid in exchange thereof. Each Finalist is responsible for all federal, state and/or local taxes, and for any other fees or costs associated with acceptance or use of any prize.

Sponsor is not responsible for any cancellations, delays or changes to the Prize in whole or in part, and Finalists will not be compensated in the event of cancellation of, or change to, all or a portion of the Prizes.

RELEASE OF LIABILITY: You agree that the Event Entities (a) shall not be responsible or liable for, and are hereby released from any and all costs, injuries, losses or damages of any kind, including, without limitation, death and bodily injury, due in whole or in part, directly or indirectly, to participation in the Event or any Event-related activity, or from acceptance, receipt, possession and/or use or misuse of the Prize, (b) the travel, accommodations for, and attendance at the Event, and (c) have not made any warranty, representation or guarantee, express or implied, in fact or in law, with respect to any prize, including, without limitation, to such prize’s quality or fitness for a particular purpose.

By entering the Event, you further agree that (a) any and all disputes, claims, and causes of action arising out of or in connection with the Event, or any prize awarded, shall be resolved individually without resort to any form of class action; (b) any claims, judgments and awards shall be limited to reasonable and actual out-of-pocket costs incurred, including costs associated with entering the Event, but in no event attorney’s fees; and (c) under no circumstances will you be permitted to obtain any award for, and you hereby waive all rights to claim, punitive, incidental, indirect or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than damages for reasonable and actual out-of-pocket expenses. These rules and any disputes relating hereto are governed by the internal laws of the State of California without regard to principles of conflicts of laws, and by entering, you consent to the exclusive jurisdiction of the state and federal courts in San Francisco, California for resolution of any disputes relating to the Event and waive any objection thereto. For New Jersey residents, the limitations set forth above are inapplicable where attorneys’ fees, court costs, or other damages are mandated by statute.

ADDITIONAL RULES: No responsibility is assumed for any damage to your mobile device or computer system which is occasioned by participating in the Event, or for any computer system, mobile device, hardware, software or program malfunctions, or other errors, failures or delays. Without limiting the generality of the foregoing, no responsibility is assumed for incomplete, illegible, misdirected, misprinted, forged, tampered with, altered, late, lost, damaged, or stolen submissions, prize notifications or other Event materials, all of which are void; or for lost, interrupted, inaccessible or unavailable networks, servers, satellites, Internet service providers, websites, or other connections; or for miscommunications, failed, jumbled, scrambled, delayed, or misdirected computer, telephone or cable transmissions; or for any technical malfunctions, failures, difficulties or other errors of any kind or nature; or for the incorrect or inaccurate capture of information, or the failure to capture any information.

Any individual who is found to be tampering with the entry process or the operation of the Nomination Period/Submission/Event, to be acting in violation of these Official Rules, or to be acting in an unsportsmanlike or disruptive manner, or with the intent to disrupt or undermine the legitimate operation of the Nomination Period/Event, or to annoy, abuse, threaten or harass any other person, may be disqualified, and Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law.

Sponsor reserves the right to modify, extend, suspend, or terminate the Nomination Period/Event, in whole or in part, if it determines, in its sole discretion, that the Nomination Period/Submission is technically impaired or corrupted or that fraud or technical problems, failures or malfunctions or other unintended circumstances have impaired the integrity, administration, security, proper play and/or feasibility of the Event as contemplated herein. If the Nomination Period/Submission/Event is terminated before the designated end date, Sponsor will (if possible) select Potential Finalists from all eligible, non-suspect entries unaffected by the problem.

FINALISTS LISTS NAME: For the name of the Finalists, send a stamped, self-addressed envelope to: GoFundMe Heroes Celebration, GoFundMe, Inc., 855 Jefferson Avenue, PO Box 1329, Redwood City, CA 94063. All such requests must be received by 12/31/2019.
