Hello, I’m Claudia, a single mother and immigrant.

My daughter was born in the United States with a medical condition called Pierre Robin sequence, which affects her jaw and palate. Since birth, she has had to undergo three surgeries in order to eat, breathe, and, in the future, speak normally. In addition, she experiences delays in her motor development and learning.

I am completely dedicated to her care, as she receives three therapy sessions at the hospital each week and one session at home. Because of this, I am currently unable to work.

I am now in a legal battle for custody.

My daughter’s father has sued me and takes advantage of his financial position and my vulnerability as an immigrant, using the fact that he was born here and knows the laws to try to obtain custody.

The court appointed a Guardian ad litem who sided with the person paying her fees — “the father.” I requested her removal, but the court denied it. Every time I try to assert my rights, I am silenced.

I have contacted every organization that “provides legal assistance,” but none have been able to take my case.

Mi hija nació en los Estados Unidos con una condición médica llamada secuencia de Pierre Robin, que afecta su mandíbula y paladar. Desde su nacimiento ha tenido que someterse a tres cirugías para poder comer, respirar y, en un futuro, hablar con normalidad. Además, presenta un retraso en su desarrollo motor y aprendizaje.

Estoy completamente dedicada a su cuidado, ya que cada semana recibe en el hospital tres sesiones de terapia y una sesión en casa. Por ello, actualmente no puedo trabajar.

Ahora me encuentro en una batalla legal por la custodia.

El padre de mi hija me demandó y abusa de su posición económica y de mi vulnerabilidad como inmigrante, aprovechando que él nació aquí y conoce las leyes, para intentar obtener la custodia.

La corte asignó a una Guardian ad litem que se posicionó del lado de quien le paga sus honorarios: “el padre”. Solicité su remoción, pero la corte se negó. Cada vez que intento hacer valer mis derechos, me silencian.

He contactado con todas las entidades que “brindan asesoría legal”, pero ninguna puede tomar mi caso.
