What many people viewed as political satire has since been transformed into a federal criminal prosecution. Despite no allegations of stolen data, damaged systems, financial gain, or national security harm, a federal prosecutor is seeking a 9.5 to 12 year sentencing range under an expansive interpretation of the Computer Fraud and Abuse Act. The charging theory relies on broad readings of “unauthorized access,” “damage,” and “loss,” despite no allegations of data theft, system impairment, financial gain, or national security harm. The conduct at issue involves AI-generated, satirical political expression. If this approach is allowed to stand, it sets a dangerous precedent. It means satire, protest, or creative expression involving digital tools could expose ordinary people to extreme criminal penalties based on prosecutorial interpretation rather than clear legislative intent. That chilling effect should concern anyone who values free speech, artistic expression, or fair and proportional justice.
