URGENT REQUEST FOR LEGAL REPRESENTATION - EMERGENCY CUSTODY MATTER
Re: Emergency Custody Modification and Parental Alienation Case
I am desperately seeking immediate legal representation to help me regain custody of my 4-year-old daughter, who was removed from my care following a CPS call by her father - the same man who abandoned us in May 2024.
Current Emergency Situation
My daughter is suffering severe emotional harm in her father’s custody.
She cries every single day asking to come home and shows clear signs of withdrawal and psychological distress. I am being systematically cut off from her through parental alienation tactics, and she is not receiving necessary medical care.
Immediate concerns:
• Daily crying and begging to see me
• Food being withheld from her as punishment (age 4)
• Speech therapy discontinued despite ongoing need
• Father “doesn’t understand” what she’s asking for and ignores her requests
• Communication time reduced from 4 hours daily to averaging 3-17 minutes
• Father makes her “unavailable” by putting her to bed early or claiming she’s sick
• I have no information about where she is or who cares for her during the day
• Signs of social withdrawal and giving up trying to communicate
Background - Father’s Abandonment
In May 2024, my daughter’s father left us to move to Indiana, claiming his friend needed help. During his absence:
• He provided zero financial or emotional support despite repeated pleas for help
• I was managing alone while dealing with serious health issues (stomach infection requiring antibiotic therapy, full hysterectomy the day before my 36th birthday)
• I was off mental health medications due to medical treatments and caring for our then-2-year-old plus three high-energy dogs
• He ignored all requests for help during my medical crisis
• His neglect of our family was the primary reason I ended the relationship
When he returned, a police officer refused to give him custody, stating in his own words that the father “didn’t know her” and that she didn’t want to go with him. Despite this, CPS ultimately placed her with him.
Evidence of Parental Alienation and Neglect
Systematic interference with parent-child relationship:
• Contact reduced from 4-hour window to 1 hour, now averaging 3-17 minutes daily
• Father hangs up on calls or makes her unavailable during designated times
• Refuses to provide his wife’s contact information or babysitter details
• Tells my daughter she “can’t come home” when she asks for me
• Social worker approved reduction without considering my daughter’s wellbeing
Educational/Medical neglect:
• Discontinued necessary speech therapy services
• Actively undermining her communication development by “not understanding” her
• No information provided about her daily care or supervision
Emotional abuse evidence:
• Daily crying episodes witnessed by family members
• Extreme distress during separation from me
• Behavioral withdrawal and giving up trying to communicate
• We are trauma-bonded from his abandonment, and separation is causing psychological harm
Physical neglect concerns:
• Food taken away as punishment at age 4
• Concerns about her nutritional needs being met
Why I Need Emergency Intervention
Every day my daughter remains in this situation causes more psychological damage. She is only 4 years old and cannot advocate for herself. The bond between us is being deliberately destroyed through parental alienation tactics, and her developmental needs (speech therapy) are being ignored.
A police officer already determined he “didn’t know her” and she was unsafe with him. Nothing has changed except that I’ve been pushed further out of her life while she suffers emotionally.
What I Am Requesting
1. Emergency ex parte custody order to immediately modify custody based on ongoing harm
2. Court-ordered 730 evaluation by a child psychologist to assess the emotional damage
3. Reinstatement of speech therapy services
4. Enforceable communication schedule with consequences for interference
5. Access to information about her care, location, and caregivers
6. Minor’s counsel to advocate for my daughter’s best interests
My Current Stability
I take full responsibility for the struggles I faced during my medical crisis. Since that time:
• I have completed all medical treatments
• I am back on appropriate mental health medications
• I have stable housing
• I am prepared to meet any court-ordered requirements for reunification
I am not asking the court to overlook past difficulties. I am asking for help to save my daughter from ongoing emotional harm and neglect happening right now.
Urgency
My daughter just turned 4 in October. The psychological damage from this separation and the emotional neglect she’s experiencing will have lasting effects if not addressed immediately. She needs her mother, she’s asking for her mother, and she’s being told no while crying every single day.
I am willing to:
• Participate in any court-ordered evaluations or services
• Attend parenting classes if required
• Submit to drug testing
• Comply with supervised visitation initially if necessary
• Do whatever it takes to ensure my daughter’s safety and wellbeing
Legal Assistance Needed
I am seeking pro bono or low-cost legal representation as I cannot afford private counsel. I need an attorney who:
• Understands parental alienation and its harmful effects on children
• Can file emergency motions quickly
• Will fight for my daughter’s right to have her mother in her life
• Can present the strong evidence I have documented
Please help me save my daughter. She is crying for me every single day, and I am running out of time to prevent permanent psychological damage.
