Sudbury Casino/Arena Legal Appeal

There are many in our community opposed to the establishment of a full casino in Sudbury.  Whether your concerns are economic, cultural, social or environmental, it is only by combing our efforts into one, that we have a real chance of preventing this project from moving forward.

In preparation for our appeal we have commissioned an economic impact report , planning reports, legal opinions and have retained legal council. We are ready to act following the city council decision on April 10th, through LPAT submissions to the OMB. We intend to appeal the casino rezoning, event center rezoning, and the casino official plan amendment.

Along with a separate legal fund campaign for businesses, (which has raised 160K of its 250K goal) we are asking the citizens of Sudbury to contribute. While the LPAT process is simple, the preparation of the appeal has been extensive , and it is likely  the appeals will result in  hearings.

Lets all work together to get our city back on track towards sustainable economic development where we embrace all that makes our city a great place to live, work and play!

Today we submitted our formal appeal to the LPAT. The actual appeal documents are over 200 pages in length, however, we have posted our 20 page synopsis of the basis for our appeal on the Casino Free Sudbury webpage.

This is the beginning of the LPAT process which we expect to last for the better part of a year. The next step is the Case Management Conference ( CMC) which will be a minimum of 75 days from the time the city sends its appeal record to LPAT sometime in early June. Over the summer, apart from some R&R, we intend to continue our fundraising efforts as we do expect lengthy hearings as a result of our appeal. This will be an expensive process.
 
This fight is about what is best for our community, our culture, local businesses and our social well being. While words of encouragement are appreciated we also require more funds to ensure a strong appeal. The vote on the 10th did not go our way, however, that was expected. It still does hurt a little to see our city completely ignore social and economic concerns of so many who presented at the public hearings, and through direct contact with councillors.

Our LPAT submissions have been prepared in advance in preparation for the appeal and they will be submitted over the next few weeks. We will advise through this campaign when they have been formally submitted.

Over the next 3 months our focus will be on fundraising as we do expect hearings in the fall and that is where most of our expenses occur. Our business campaign fund is steadily rising and we are very grateful to all of you who have donated through this GoFundMe campaign. Consider having an LPAT party or other type of event to raise funds ( Invite me!).

Our legal council has high confidence in our appeal and we will post updates regularly on the www.casinofreesudbury.com webpage.

Our council is Mr. Gordon Petch of Municipal Law Chambers in Oakville, Ontario. He was introduced to us by a respected local lawyer. I have no relationship with him. All funds from this campaign will be transferred directly to him to be held in trust.

If mother nature co-operates and finally puts winter to bed, perhaps we can all have some outdoor fun as we wait for things to again heat up in this effort, later this summer or fall.

With only 4 days to the April 10th vote by council now is the time to write your councillor and encourage others to do so.
Nothing would make me happier than to hit the " Refund All" button on this site.
Today the Sudbury District Medical Society and a large portion of the faith community have formally joined our legal appeal. There are several other groups who will be joining in the coming weeks making this truly, a community effort.
