Homeward bound

My name is Christina. I currently reside in Houston, Texas and an officer in the Army National Guard. While in training, a judge in the New Jersey took my children from me without jurisdiction and not in accords to Uniform Child Custody Jurisdiction and Enforcement Act (UCCJEA) requirements.

Chain of events: 
The judge misused the authority given to him by the Courts, broke up a family and has caused an extreme amount of emotional distress. In December 2013, the NJ judge gave primary custody of my 4 kids (13, 8, 7, 6) to their father stating that because he could not reach the Florida judge, because there was nothing pending in TX and even though the children were not in NJ he was going to act as if they were.

In October 2014, their father came down to TX and withdrew my children from school without my knowledge and drove them back to NJ.

In December 2014, this same judge denied my change of venue and gave sole custody to their father stating that he did not want me signing them out of school and that he did not want me to take them out of NJ. There was no assessment conducted. There was no visitation rights given to me. The judge however ordered me to pay child support knowing that the father was over $24,000 in arrears with me.

Recently, I discovered that there was a court hearing conducted in January 2014 without my knowledge in this same court, giving the father rights to pick the kids up based on false information the judge provided on the order. And the order was also a warrant for my arrest because I would not return the kids to their father's house.

All this happened while I was waiting for Florida to relinquish jurisdiction so that I could have it transferred to Texas. However, Florida did not relinquish jurisdiction until February 2014. Yet this order has been holding for almost 2 years. 

Due to the position given to this judge by the State of New Jersey, my kids were taken away from me and given to their father due to no error on my side. The judge was aware of a number of factors that would cause this to be thrown out, yet he did what he wanted  to anyways. 

My new attorney has managed to have the old judge removed from the case. My next hearing is on October 23, 2015. I'm confident that my children will be returning home and am requesting funds to be  able to drive up to NJ, pick up my kids and their belongings and return them home. What extra I may have with this fund will go toward school supplies for their schools here and help toward the lawsuit that will follow. (I have not been able to save money due to the almost $10,000 I have had to fork over for 3 attorneys).

If anyone reading this has kids, you can imagine the nightmare I have been having to endure. To watch your kids get on the school bus but not get off it. The funds raised will aid in reuniting this family without causing a hardship on us as we work to rebuild. Any amount will be a blessing. It will offset the kids' trip home and any overage will assist in the legal fees that will be dearly needed in the future. I will forever be grateful to those that give to help this family have a voice.
