#FreeAida: Her children need community support!

Dear community members and allies,

Aida was apprehended by ICE on November 19, 2018 as she was leaving her home due to a "red notice" issued by the interpol alleging that Aida is wanted in El Salvador in connection to theft, even though Aida hasn't been in El Salvador for more than 6 years. The DOJ's own guidance states that  “the United States does not consider a Red Notice alone to be a sufficient basis for the arrest of a subject because it does not meet the requirements for arrest under the 4th Amendment to the Constitution.”

However, ICE continues to  break the law and has refused to release Aida on prosecutorial discretion, despite the fact that she never missed a court hearing, but most importantly she was taken away from her 2-month-old baby who was born premature, and her 4-yr old daughter, who desperately need their mother back.

We are asking community members for donations to help Aida's family care for the new born baby and her daughter. All proceeds will be used to cover Aida's children's needs including:

Since Aida's baby was born premature, he is also being taken to the doctor regularly and given medication, hence your donation will help alleviate transportation costs, and other medical expenses.

Background:

Aida is a 28-year-old woman from El Salvador. As a child she suffered physical and verbal abuse. At the hands of her partner, she suffered severe domestic violence for which she required hospitalization. Aida fled E.S. in 2012, certain that the escalating nature of her ex-partner’s threats and physical abuse would result in her death. Aida’s final asylum hearing was scheduled for February 2019. 

Since coming to the U.S., Aida has begun to heal from her trauma. She was connected to therapy, and recently gave birth to her two-month old son, Mario. Aida suffered pregnancy complications and Mario was born two months premature. Aida is also the main caretaker for her 4-year-old US citizen daughter. 

On November 19, 2018, Aida was detained by ICE as she was leaving her home. On the day she was detained, her attorneys requested her release and submitted evidence that Aida has been complying with her immigration court obligations, and that she had two young children who needed her. ICE refused to release Aida, refused to explain why she was being detained, and refused to serve any paperwork on her attorney.

More than a week later, Aida’s attorneys learned through a congressional inquiry, that Aida was being detained on a so-called “Red Notice” issued by Interpol alleging that Aida is wanted in El Salvador in connection to theft, even though Aida hasn't been in El Salvador for more than 6 years. The Department of Justice’s (“DOJ”) own guidance states that “the United States does not consider a Red Notice alone to be a sufficient basis for the arrest of a subject because it does not meet the requirements for arrest under the 4th Amendment to the Constitution.” ICE is using the notoriously flawed Interpol notice system to claim that Aida must be detained, even though no evidence has been presented against Aida, and even though she has no criminal history. ICE has ignored evidence from the medical community stating that Aida should be with her newborn son. Aida is worried about the health of her children, especially her newborn son, as she sits in detention. Because ICE arrested Aida right before her postpartum appointment, Aida not seen an ob-gyn to complete her postpartum care and is worried about abdominal pain. 

ICE’s refusal to release Aida is another example of their inhumane practices of separating families. Since Aida is unable to withdraw the funds while in detention, Alicia Cuautle, member of Aida's coordinating campaign team will be withdrawing the funds on her behalf and ensure that her kids receive all fundraising proceeds.
