In preparation for an impending transition from a Developer controlled HOA to a Homeowner controlled HOA, we will need to seek legal counsel for review of finances, policy & procedures, and Covenants, Conditions, and Restrictions (CCR's), as well as obtain legal advice on process, procedure, rules, regulations, and laws for forming a new board and navigating the transition.
At the community meeting on Saturday, September 9th, there was consensus that we should obtain legal counsel to begin this process.
It is hoped that each homeowner can contribute $20 towards the cost for the initial legal consult.
Although this will initially be considered a donation to the community cause, this Go Fund Me site will also serve as the documentation trail for contributions. So if you would like the opportunity to have this donation refunded, please do not use the anonymous donation option.
Within the NC State laws, we will seek to have the newly elected board reimburse these legal fees to those donors, since these are deemed to have been in the best interest of the association at the time.
However, if the result of the initial legal counsel warrants no further legal action and there are remaining funds and/or state laws prohibit such reimbursements, all remaining legal funds will be handed over to the newly elected board for inclusion into existing financial holdings.
