My name is John Monteagudo and I am writing this on behalf of my mother-in-law. Her name is Teresa Gomez.

She is 92 years old and has paid every monthly HOA on time. However, she is facing foreclosure from her HOA, The Village Woods.

They assessed special emergency assessments three times in the past two years due to increases in insurance. My mother-in-law did not understand this as she is 92 years old and gets easily confused. She assumed as the HOA monthly dues are paid current this was a scam or mistake.

She asked her daughter, Janette Gomez Monteagudo, and myself to look into it. We discovered that this was a legitimate debt and due to exorbitant fees she now owes exactly $12,611.72 as of 4-5-25.

I have spoken to a lawyer at Elder Care Advocacy and she confirms that although some of these assessments may be questioned legally as far as whether they were an "emergency," she feels that in the end legally it is an enforceable debt and they have the right to foreclose.

My wife is a teacher and I am retired and have no way of paying this. e.

My concern is for my 92-year-old mother-in-law who has severe health issues. She cannot survive being homeless and we have no room for her in our place.

To add insult to injury, while walking his dog, Oreo, her IHSS worker was told by a member of the HOA board that "It's going to happen. I don't know when but it's going to happen." He then explained he is going to move his son into the unit.

We have offered the HOA lawyers and HOA a payment plan on two separate occasions. They have rejected it outright without a counteroffer.

I have asked for $13,000 because there may be more fees tacked on since April.
