Support Samara Mcleod's Fight for Fair Custody

My name is Samara Mcleod and I am 38 years old and I am father or 4. Unfortunately I have a custody battle that never ends. Our daughter is 12 years old soon to be 13 in January. I am hoping I can get some help to hire a custody lawyer and a defense lawyer. Here is my story.

I have put together a very detailed report regarding the Custody case of our daughter. Since our daughter birth her mom ultimate goal is to gain sole custody of our daughter and will go to the extreme measure or will fabricate any story to make sure she is granted full custody. Her mom will tell there is a communication (which at times there is) but the communication barrier usually happens when Her mom does not benefit from it. Our daughter is a very smart girl, she has always excelled in academic and sports, she is outgoing, charismatic, loving, and always willing to learn.

My custody battle started in 2012 with her mom January 8th 2012 Suri was born- I had just moved into my new place of living, I was not able to witness the birth of my daughter due to her mom request, I found out because my mom had message me stating sure was born. I had no say so in anything even down to her name. During this time my parental right we’re limited because her mom was staying with her mother at this time. At this time I decided to file court papers regarding my parental right in May of 2012. (Keep in mind I had full custody of my older daughter Ebany)

In May of 2012 we agreed to a temporary Parental time which allow me to see our daughter from 1:15pm to 3:15pm on Mondays, Wednesday and Friday. In November of 2012 a permanent order was entered which increased my parental time to Every Tuesday through Saturday from 8:30am to 1Pm. This parental time was supposed to change once her mom was done breast feeding, to 50/50 on a 2-2-3 schedule. Well this never happened.

On August 6th 2013 Upon when the 2-2-3 schedule was supposed to take place her mom fabricated a story so she can obtain Sole Custody, allocation of parental responsibilities and decision making for of our daughter. On August 5th 2013 she had filed a restring order that was denied on August 6th 2013. On August 7th 2013 Her mom applied for a restraining order claiming i assaulted her and it was granted. I was falsely accused of assault by her mom, she accused me of body slamming her on the pavement causing boldly harm. Her mom called the police 3 time to report the crime and on the 3rd call stated she was assaulted. After wards her mom went and filed a protection order and included our daughter. I was not able to see our daughter for almost a year. In the order she stated that our child was afraid of me and had night tremors, even accused my daughter and our house hold of molestation. A CLR was appointed to our and he testified that those accusation were not true. Knowing I was innocent I decided to fight the case. My parental time was modified again and my time with our daughter stated I would get our EVERY WEDNESDAY FROM 10 AM UNTIL 6PM and alternating weekends from 9 am on Friday to 5pm on Sunday.

In August of 2015 I was foundNOT GUILTY on ALL Charges, and a permanent order was put in place. My I award 50/50 custody with spilt decision making. My parental time is the following (long weekend) Wednesday-Monday (Short weekend) Wednesday-Friday morning. This order has been in place for 9 years. Immediately after being granted my parental time her mom would try to plan event and function on my time with my daughter and would ask continuously ask to pick her up early on my time.

Fast forward to why we are hear today. On August 28th 2024 I recieved a text message from her mom stating she was keeping our daughter. Knowing it was my day to have her, she made plans to take her to the state fair. Later that day at our daughters soccer practice (which i coach her team) her mom showed up trying to serve me court paper's that weren't approved by a judge. I refused to take her paper work and had to remove my daughter from practice. Her mom followed me to my car still trying to serve me the paper, she had brough a WITNESS (she works with the witness at the shcool). Her mom claimed that I pushed her and her 2 year old son down to the ground. This whole incident was record by her mom. I called the cops at 6 pm but the cops never showed up. She filed a Emergency hearing on August 30th stating our daughter is in danger and that i had assaulted her.

Sept 6th 2024 we had court for the Emergency hearing with we had to provided evidence of what took place on August 28 2024. I was able to cross examine her and her WITNESS. Her mom had also provided the video of what took place on the 28th. At the end of the court appearance the judge needed time to review the video and would make a decision on Monday September 9th 2024

September 10th 2024 I was FOUND NOT GUILTY on all accusation. The video proved she was the aggressor, and it is illegal to try and serve someone court document that weren't signed of by the judge. The video showed that at no time did i every assualted her or her 2 year old son.

I am creating a gofundme because this has to stop. I can't continuously living my life wondering what is the next accusation she is going to make or continue to emotionally affect our daughter well being and mental state. I am seeking to retain a lawyer for the custody side and criminal side. I understand life is tough for every, and I'm not asking for a hand out but any donating will help me retain a lawyer for myself and my daughter.
