Support Nicholas and Giulian's Fight for Safety

On September 1st, 2024, my son Nicholas (5 years old at the time) came to me during visitation hysterically crying and trembling that he and his (3 years old at the time) brother Giulian were being hit by their Mother’s boyfriend. I immediately called DCF and Law Enforcement to which an investigation was conducted. From the report on September 1st, their Mother admits that “she is aware of the spankings.” My first question was, at 3 and 5 years old, what could they possibly do to need a “spanking.” Are you kidding me?! Upon receipt of this investigation, my attorney submitted an emergency order to bring this matter before the judge. On September 24th, 2024, the judge sustained a motion that “the Respondent shall not allow her paramour to physically discipline the minor children.”

Fast forward to this past week, I picked my son Giulian up from daycare Tuesday morning and he told me that Mom’s boyfriend hit his brother Nicholas in the back of the head on Sunday. I immediately contacted my attorney and told him what my son had told me. However, I waited until my son Nicholas got out of school to confirm before I took further steps. Upon confirmation, I immediately called Law Enforcement and DCF. From the attached police report, in a secluded interview with Nicholas, the police reported “I then spoke with Nicholas Zotto Jr, who stated that Tyler had hit him in the back of the head while they were at the AirBnb.”

I had my day in court and presented evidence to include the attached police reports that involved secluded interviews with my boys by both police and DCF. However, their Mother lied and manipulated the court into taking stories that weren't true to protect her boyfriend. Despite factual evidence that my boys are deathly afraid of this man, they were sent back to their Mother's without a solution. The truth is the truth and reports don’t lie.

As we all know, men in the court system are automatically given the bottom hand from the jump. At this point I have no other choice but to hire child advocates and therapists to conduct investigations because my son’s safety is all that matters to me. The system is failing my boys and I will not stop protecting my children to ensure their utmost safety.
