I am a single mother fighting for my son’s safety, protection, well-being and for justice. My son’s grandmother and I have been fighting for my son’s protection and best interest, relentlessly, for the past ten years. (The 3 years we had 'off' were during Covid.)
The first matter we endured was 2014-2019 where we won full protections for my son in 2019. My son thrived under those orders, with full safety and protection.
Since 2022, we have dealt with another legal battle, again, fighting to protect my son’s safety, health, well-being and best interest. My son’s father filed in a court in his home state different than the court that issued our Final Order in 2019.
(My son was not born in the state where Father lives and my son only lived there for 3 years 2016-2019 before moving back to Ohio, his birthplace, in 2019. Since 2019, my son only spent 4 hours, between 2019-2023, in the state where Father lives. We had not lived in the state for over 3 years when the father filed in the court.)
This court, where the dad’s contacts work for the court system, radically changed our 2019 Final Orders.
The out-of-state court has terminated all child support from my son without the father having to show any of his financial information to the court. (I was required to turn over all financial documentation and, thus far, he was not held to the same court-ordered requirements of the law.)
All the protections we had for my son were stripped away.
When a child is asked what their preferences are and the court does not listen to the child, it can be considered abuse of discretion.
In March 2025, I filed an appeal in the other state. But the appeal could take as long as 9 months, and it requires endless effort and fighting on my part spending weekends and holidays tirelessly writing legal documents. When a person’s due process is violated, their welfare inevitably becomes destroyed. No matter how hard I work, I cannot build security where injustice exists.
I am not entitled to free legal aid in this out-of-state court, (yet another deprivation of rights that contributes to the destruction of welfare), and any funds I am able to raise need to go toward legal representation for this urgent and critical appeal.
I must keep fighting. But, this fight has taken a devastating toll on my family and I, both emotionally and financially.
