Help Kody Fight for Fair Custody of His Daughter

I am humbly asking for help from anyone who feels moved to support a devoted father in the middle of a heartbreaking and financially draining custody battle. Please keep reading and should you feel moved in any way to help donations and prayers are what the family needs at this time. All proceeds from donations will go directly to Kody’s lawyer to help him continue his fight for equal rights. Proof of payment will be provided upon request!

A Quick Overview:

Kody and his ex-partner separated before finding out about the pregnancy. Their daughter, Scarlett, was born in June 2023. At the time, Kody was unaware of his legal rights and didn’t retain counsel until after the state opened a custody case. He’s been fighting for fair parenting time ever since October 2023.

He completed every supervised and unsupervised visit laid out in a 12-week parenting plan that was created during mediation with his previous counsel that fooled him into agreeing not knowing Kody could say no and go in front of the judge. The lawyer quit shortly after this. Kody only agreed to mother’s request for supervised visits under her watch because he thought he had no other option. He never missed a single one. Mother claimed he abandoned their child. However, he did not. He struggled mentally having to go to her house to be watched by her, her live-in boyfriend and her family as she would not let him leave her house with the child nor leave with his family. He had no choice but to sit in her home. He has no criminal background, no violent or drug history either which is even confirmed by mother in a court document. Yet she still required he do supervised visits.
Even after fulfilling all the court’s expectations, and mother’s expectations, the mother objected, pushing for full custody. Mother argued that she could not in good faith keep the order they originally agreed upon because (exact words from mothers objection) "Father was fully aware that his choice, not only to lie, misrepresent and secret critical information form mother, but also his choice to move an hour away from his child in the instant matter to be with someone he impregnated. His lack of good faith should not be rewarded" He never lied and this was proved in the objection court hearing in August 2024 where father was awarded his parenting time to remain. Essentially father is punished for moving on, having a healthy relationship, and another child. Mother only agreed to their order under the impression he was single, would remain living with his parents. None of this was ever agreed on.

The judge denied her objection motion but set a trial at mother’s request for November 2024, which led to a mediated outcome instead granting Kody just under 40% parenting time.

What’s Been Happening Since:

Since the custody order went into effect, the mother has repeatedly attempted to undermine Kody’s court-ordered rights, filing legal objections and accusations that drive up legal fees. All of her objections have been found untrue and proof has been provided against all claims. Her attorney — who also served as her guardian ad litem in a previous case where the mother was the child in the case with her parents — continues to engage in costly back-and-forths with Kody’s lawyer. Kody has not once objected to the order, he has constantly and routinely followed the order, never broke the order, and tries to focus on just seeing their child but mother continually tries to add barriers to this.

Kody has already spent over $26,000 in legal fees and still owes over $6,000 to continue retaining his lawyer. (His current lawyer is wonderful). Mother and her lawyer call and email his lawyer any time the mother does not agree to something which continues to increase the bill.

On top of that:

Kody has not missed a single child support payment.

He pays $517/month in child support, which includes 150/month toward arrears — arrears created by Michigan’s law that backdates support to the start of the case, before he even had the right to parent.

He was automatically assigned over $7,000 in arrears simply because he didn’t give birth and didn’t have 50/50 custody from day one, and lied stating he was making more money than he was because he was worried he wouldn't get any custody without a job. So child support based his support on an income he didn't have.

He pays an additional $18/month in ordinary medical expenses (above what Michigan requires) since mother has child on state aid, and he pays $213/month to provide private insurance for Scarlett as well. He provides any and everything Scarlett needs at his home while also providing for his son, her brother as he should.

Despite limited income and no outside financial support, Kody has never backed down, never missed a payment, and never missed a moment with his daughter when allowed. He has never objected to the court orders, never turned mother away from her parenting time, and has tried everything to be able to see his child with no interference.

Why We’re Asking for Help

Kody is doing everything he can — emotionally, physically, and financially — to stay in his daughter’s life. He’s up against a well-supported legal team (mother has minimal bills, and has a father and grandparents who fully support and help fund her legal fees) and a system that’s been hard on him from the start as most legal systems are when you are the father.

    •    Preserve the relationship he’s built with his daughter through relentless effort
