Howard's Pharmacy in Lakeview has been hit with an order from OSHA not to let the public into the store.

According to OSHA, Howard's Pharmacy was allowing customers into the store without face coverings. Employees were interacting with customers and each other without wearing face coverings as well.

Howard’s Drugs has moved to curbside only service for the time being. Prescriptions and any other products we sell are still available to the public. However, no one from the public is allowed into the building at this time.

Call in prescriptions as normal, please continue to allow 48 hours for processing.

If you need anything; medications, sundries, UPS drop-off, etc.; feel free to stop by or call.

Our Reasoning:

The Statewide Mask, Face Shield, Face Covering Guidance from July 24th contains the following section:

“Individuals who have a medical condition that makes it hard to breathe or a disability that prevents the individual from wearing a mask, face shield or face covering can request an accommodation from the business or indoor/outdoor space operator to enable full and equal access to services, transportation, and facilities open to the public.”

This is the current mandate. It specifically states that those who cannot wear any of the required coverings can request an accommodation that enables “full and equal access” to the “services” and “facilities.” There is only one way to be compliant with this: there can be no difference in access between those who cannot wear a mask and those who can. Any variation would no longer be “full and equal” but rather “partial and unequal.”

OSHA’s position would require that Howard’s Drugs violate its ethical principle not to discriminate against its customers, in addition to requiring the business to be out of compliance with the OHA mandate. OSHA was unwilling to even discuss the Guidance and the meaning of “full and equal access.”


Howard’s Drugs had only two options before it: discriminate against those in the community who could not wear anything over their faces or close to the public to eliminate the disparity between the two groups artificially created by the mandate. We chose the latter as it was the only way to serve everyone equitably.

OSHA, responding to fewer than ten complaints, brought this inconvenience upon our community.


The vast majority of our county has a great “live and let live” attitude that makes it a pleasure to serve. We realize that going curbside is an inconvenience but it allows us to continue operations.

We support Howards and their fight against this mandate. It looks like they may be incurring legal fees and fines, so any support that people would care to give would be appreciated. Howards would be very transparent with expenditures, and it would only be used for legal fees and fines. If there was anything left over it would be donated back to the community.
