Hi my name is Alberto C. Guerra Jr. I was born in San Diego and was raised on the border town of San Ysidro.On the 4th of July I was returning home from Mexico thru the San Ysidro port of entry .I was stationary in my car in a safe location, next to an active lane were I could safely remain stationary in my car.I was confronted and ordered out of my car by the CBP with no probable cause.I was handcuffed and led into their office from behind the yellow post before the actuall us port of entry were I was handcuffed to a bench and then turned into the custody of the CHP .I was continually handcuffed for 4 hours without any relief. the CHP officers handcuffed me until he obtained a warrant from a judge, to draw blood from me against my will.The judge granted the warrant based on hearsay since CHP never witnessed me in a car.CHP obtained a warrant based on hearsay from CBP.I asked for my Miranda rights to be read to me from the arresting officer and he refused .I was booked into jail and spent about 10 hours in custody.my car was towed and impounded.i caused no public disturbance.I did not injure anyone and I did not damage any property.i declared I was travelling in my personal conveyance and not conducting commerce to both CBP and CHP .It's time to check the system procedures and rules because I believe my constitutional rights were violated and I will challenge the system to Acknowledge the Constitution Of The United States and Supreme Court on behalf of myself and all mankind.I intend to use the funds for legal fees and expenses related to my battle against an unlawful system and my defense against accusation of DUI.
