Help Protect Our Neighborhood: Fund Legal Representation Against Overdevelopment
Our community is facing a major challenge: a proposed 36-unit apartment complex at the site of the BLD Diner that threatens our environment, traffic safety, property values, and quality of life. Despite widespread concerns, this project is moving forward without adequate safeguards in place.
We have an opportunity to retain an experienced land use attorney to represent our community and ensure that our voices are taken seriously. Legal representation will:
Hold the Planning Board accountable for fully vetting this project and addressing our concerns before any vote.
Ensure the developer follows all legal and environmental regulations and does not bypass critical requirements.
Put the right documentation on the record so that if the special use permit is approved improperly, we are prepared to file an Article 78 appeal.
Force the developer to consider community concerns, potentially leading to much-needed revisions before approval.
Why This Matters
Environmental Impact: The project sits adjacent to the Premium Salt Marsh Wetlands, home to vulnerable species like the Common Loon. The developer’s Environmental Assessment fails to address contamination risks from past gas station spills or the impact on the wetland ecosystem.
Traffic & Safety: The project lacks a dedicated loading zone, meaning delivery trucks will block Boston Post Road and cut through residential streets, creating safety hazards. No pedestrian safety plan has been proposed for the many children who walk to school in the area.
Property Values: A property assessor has indicated that homes near the development could see a 20-25% reduction in value—a direct violation of the special use permit approval standards.
Rooftop Amenity Concerns: Noise, light pollution, and lack of privacy for surrounding homes could significantly impact neighbors, setting a dangerous precedent for future projects.
