Stage 1 We did it! Thanks to your extraordinary support, we've raised the $180,000 needed to enter the Land & Environment Court. But that just establishes our case.
Stage 2 Fundraising is now underway. We must secure independent expert evidence required by the court, including specialist environmental and risk assessments.

Our next target is $300,000, which will allow us to engage the experts necessary for this phase of proceedings.

This case is progressing step by step. We will continue to update the community as we move through each stage.

Later stages will include final hearing preparation and specialist legal advocacy. As the case progresses, the community will be kept informed about what’s needed next.

S. 34 Conciliation Conference Update
On Monday 17 November 2025, the parties in Repoly Pty Ltd v NSW Independent Planning Commission and Ors, a Class 1 development appeal in the Land and Environment Court, attended a Court-directed Conciliation Conference pursuant to s 34 of the Land and Environment Court Act 1979.

The Conciliation Conference is a mandatory alternative dispute resolution process. It began with a public phase that was held at the site of the proposed development.
During the public phase, six community objectors chosen by the IPC made submissions that were heard by the Commissioner, the parties and their legal representatives.
Following the conclusion of the public phase, a private session of the Conciliation Conference was held at the Picton Local Court. The contents of that part of the Conciliation are, and remain, confidential to the litigants.

The Conciliation Conference has been adjourned to 19 March 2026. If the Conciliation is terminated then or subsequently, the matter will return to the Court for the allocation of hearing dates sometime in 2026.

29 July: First Notice of Motion hearing. Beatty Hughes & Associates appeared for the Respondent and was formally joined to the case.
5 August: Community meeting held at Moss Vale RSL Club.
14 August: Deadline for eligible objectors to apply to be heard in the appeal.
18 August: Directions hearing scheduled.
1 September – IPC’s SoFAC is due.
25 September – 2nd and 3rd Respondent’s SoFACs are due.
2 October– Applicant’s SoFAC in Reply is due.
14 October - Garvan Institute of Medical Research SoFAC due
17 November – s 34 Conference (adjourned)
19 March 2026 - s 34 Conference
