On February 23rd, 2026, the Brownsburg Advisory Planning Commission approved the Hawk’s Landing primary plat, a residential development by David Weekley Homes. The APC ignored multiple technical issues, the legally binding zoning ordinance, and the concerns raised by citizens over the last 2 years fell on deaf ears.

This pending development is located behind Connection Pointe Christian Church in Brownsburg, IN. The original concept plan was approved for R-3 zoning in 2021, and included a vehicular bridge to join the two parcels for sale that are separated by White Lick Creek.

The developer has eliminated the bridge due to cost and environmental impact. The solution provided is to construct the primary entrance directly off County Rd. 800 N, and to add an attachment to a stub entrance in the Windridge subdivision. This is a substantial change to the original zoning approval, and this project should be required to be re-zoned. This raises serious concerns for the surrounding community, including pedestrian safety, traffic flow, and infrastructure capacity.

The main entrance to the subdivision will be constructed directly to the east of the personal residence of Olivia Head. Head is the founder and CEO of Oinking Acres Farm Rescue & Sanctuary, and her personal property functions as an extension of the main sanctuary and is used to house the farm’s most vulnerable animals.

Per the design submitted to Hendricks County in a memorandum of understanding, approximately 8000 square feet of her yard will be taken to provide deceleration lanes and curb cuts. Head and surrounding neighbors declined to sell their yards to the developer when approached in 2024. Now, it will become a county issue and eventually taken via eminent domain.

There is only one remaining path to challenge the APC approval, and that is filing a judicial review in court. Under Indiana law, that must be done within 30 days. Once that deadline passes, the approval is permanent.

We are now inside that 30-day window.

Over the past week, the Stop Hawk’s Landing team has contacted multiple attorneys to determine whether a judicial review is possible. We have identified one that specializes in zoning law, is highly qualified, and has an impressive resume. We believe she can help us.

She was candid about what this process requires: obtaining and reviewing the entire administrative record from the February 23rd meeting, analyzing legal errors, drafting a petition for judicial review, and preparing for oral argument.

This is not a simple filing. It is intensive, time-sensitive litigation.

To move forward, we must retain counsel by this Friday, March 6th, in order to meet the statutory deadline. The required retainer is $30,000.

We are asking the Brownsburg community to help us raise funds for the retainer.

We have already received two $5,000 commitments from Windridge neighbors. But there are hundreds of families affected by this outcome.

If we do nothing, Hawk’s Landing moves forward without further scrutiny.

There will not be another opportunity after this to stop it.
