<div><strong>The time has come for us to ask again for funds to support our legal effort.</strong> At this point, we need to raise approximately $15,000. This case is ever-evolving, and we are asking for money only as the need arises.

<div>This community showed up for this movement before. At the start of this, we raised $30,000 in under 36 hours—an amazing feat. More than 100 donors contributed, and that money has carried this case for the past five months. We are now asking the community to show up again.

<div>We already have multiple $500 commitments. Please consider joining your neighbors in our continued fight. The only way we stand a chance of stopping the irresponsible development known as Hawk’s Landing is through this Judicial Review.

<div><strong>And now for an update on our case.</strong>

</div>
<div>On August 3, David Weekley filed a motion to dismiss for lack of standing. In their motion, they argue that we are not sufficiently aggrieved by Hawk’s Landing to even ASK a judge to review the record. 
</div>

</div>
<div>We are not surprised by this. From the start, David Weekley has NOT been the community-minded developer that Connection Pointe Church has claimed they are.
</div>
<div><br />
</div>
<div>We are not wavering. Our attorneys are working to file our response to this motion. The deadline to file that response is August 24, and we plan to meet that deadline. We are confident that we are sufficiently aggrieved by this development to have a judge review the record. 
</div>

</div>
<div>Additionally, as you may recall, our attorneys have already filed the bulk of the official record. We were granted an extension by the Court to file additional documents we believed were missing. There is now a dispute with the Town of Brownsburg’s counsel regarding these additional documents. Therefore, in order to ensure these documents are included, our attorneys will be asking the Court to decide the matter.

<div>When the Brownsburg APC approved the Hawk’s Landing plat after the February 23 meeting, we knew we were in for a fight. <strong>You have been with us every step of the way, and we hope you will continue to stand by our side as we work to right this wrong.</strong>

<div>On February 23rd, 2026, the Brownsburg Advisory Planning Commission approved the Hawk’s Landing primary plat, a residential development by David Weekley Homes. The APC ignored multiple technical issues, the legally binding zoning ordinance, and the concerns raised by citizens over the last 2 years fell on deaf ears.

<div>This pending development is located behind Connection Pointe Christian Church in Brownsburg, IN. The original concept plan was approved for R-3 zoning in 2021, and included a vehicular bridge to join the two parcels for sale that are separated by White Lick Creek.
</div>
<div><br />
</div>
<div>The developer has eliminated the bridge due to cost and environmental impact. The solution provided is to construct the primary entrance directly off County Rd. 800 N, and to add an attachment to a stub entrance in the Windridge subdivision. This is a substantial change to the original zoning approval, and this project should be required to be re-zoned. This raises serious concerns for the surrounding community, including pedestrian safety, traffic flow, and infrastructure capacity.

<div>The main entrance to the subdivision will be constructed directly to the east of the personal residence of Olivia Head. Head is the founder and CEO of Oinking Acres Farm Rescue &amp; Sanctuary, and her personal property functions as an extension of the main sanctuary and is used to house the farm’s most vulnerable animals.
</div>

<div>Per the design submitted to Hendricks County in a memorandum of understanding, approximately 8000 square feet of her yard will be taken to provide deceleration lanes and curb cuts. Head and surrounding neighbors declined to sell their yards to the developer when approached in 2024. Now, it will become a county issue and eventually taken via eminent domain.
</div>

<div>There is only one remaining path to challenge the APC approval, and that is filing a judicial review in court. Under Indiana law, that must be done within 30 days. Once that deadline passes, the approval is permanent.
</div>

<div>We are now inside that 30-day window.
</div>

</div>
<div>Over the past week, the Stop Hawk’s Landing team has contacted multiple attorneys to determine whether a judicial review is possible. We have identified one that specializes in zoning law, is highly qualified, and has an impressive resume. We believe she can help us.
</div>

<div>She was candid about what this process requires: obtaining and reviewing the entire administrative record from the February 23rd meeting, analyzing legal errors, drafting a petition for judicial review, and preparing for oral argument.
</div>
<div><br />
</div>
<div>This is not a simple filing. It is intensive, time-sensitive litigation.
</div>

</div>
<div><strong>To move forward, we must retain counsel by this Friday, March 6th, in order to meet the statutory deadline. The required retainer is $30,000.</strong>

<div>We are asking the Brownsburg community to help us raise funds for the retainer.
</div>

</div>
<div><strong><em>We have already received two $5,000 commitments from Windridge neighbors. But there are hundreds of families affected by this outcome.</em></strong>

<div>If we do nothing, Hawk’s Landing moves forward without further scrutiny.

<div>There will not be another opportunity after this to stop it.
