In Queensalnd and generally, through common law of Australia, public entities are required to act and make decisions in a way that is compatible with human rights. In Queensland this is legislated in section 58(1)(a) of the Human Rights Act 2019 (Qld) (QHRA).
Further, when making decisions (in Queensland), public entities must give proper consideration to a human right that is relevant to the decision (section 58(1)(b) HRA.
These rights are also documented in the Universal Declaration of Human Rights (UDHR) and the International Covenant on Civil and Political Rights (ICCPR), which are both recognised internationally.
On 16 April 2025, at my private property located at 477 Gatton-Esk Road, Adare, Queensland 4343, my human rights were contravened under the QHRA, including the right to property under section 24 and the right to privacy and reputation under section 25. These rights are also recognised internationally under Article 12 of the UDHR, which provides that:
“No one shall be subjected to arbitrary interference with his privacy, family, home or correspondence, nor to attacks upon his honour and reputation,”
and under Article 17 of the ICCPR, which protects individuals from arbitrary or unlawful interference with privacy, family, home, and reputation.
These interferences were purportedly justified under the National Fire Ant Eradication Program (NFAEP), a biosecurity program operating in Queensland.
In Queensland, the HRA does not give absolute rights. Instead, the HRA provides that rights may be subject to reasonable limits that can be demonstrably justifiable in a free and democratic society based on human dignity, equality and freedom: section 13(1) of the HRA.
Public Officers of the NFAEP and Biosecurity Queensland recruited oficers of Queensland Police Service (QPS) to assist them forcefully enter and distribute toxic chemicals on the property through correspondence which labeled me (unjustifiablly) as being anti-government and having soverign citizen ideology. The action of QPS caused injury, requiring medical attention, resulting in lost income and difficulties in fulfilling duties of my work and personal life.
These actions were not reasonable and can not be substantiated, as required in the QHRA. Limiting my rights in this circumstance can not be demonstrably justifiable in a free and democratic society based on human dignity, equality and freedom.
Due to the injury, which resulted from excessive force from QPS officers, QPS officers discussed the need to charge me for obstructing police under s 790 of the Police Powers and Responibility Act (QLD) 2000 (QPPRA) in a clear abuse of power.
There are several reasons why these actions can not be demonstrably justifiable in a free and democratic society based on human dignity, equality and freedom, some of which are detailed below:
1. There was no evidence of fire ants on or in the near vicinity of the property, either prior, on the day or since 16 April 2025.
2. Implying unsubstantiated claims of anti-government or soverign citizen idealogy to QPS prior to their arrival, without right to reply, creates a prejudice that is unfair, creating a preconcieved need for violence and aggresive behaviour by the QPS against me.
3. I had experienced and reported adverse effects to the chemical distribution of the NFAEP to my susceptible Galloway cattle including the death of two calfs,
4. I had invested and commissioned alternative fire ant mangement strategies which does not utilise harmful chemicals and is a scientifically proven method to manage properties free of fire ants. which was not accessed by the NFAEP as an alternative mitigation strategy as per the NFAEP compliance and enforcement strategy 2023-2027.
I now have to defend against two charges of Obstruct Police under section 790(1)(b) of the Police Powers & Responsibilities Act Qld.
I am also looking at holding those who tresspased against me responsible by initiating civil matters and private prosecution of criminal actions against those involved.
In addition, I want to continue my work developing biosecurity mitigation strategies that utilise chemical alternative technologies.
It is hoped that these actions can help create a better Queensland and force government departments, including QPS and the Department of Primary Industries (QLD), to respect human rights and the values of people and business who object to unnecessary chemical exposure and forced chemcial treatment without first giving proper consideration to chemcial alternatives and mitigation strategies.
