Linda Smith and her neighbors need their day in Court
Here in Saratoga Wyoming, the neighbors of the property at 1503 S. River Street have lived peacefully for years, next to a retail farm supply business. Recently the business was bought by the Memorial Hospital of Carbon County (MHCC) to construct a medical clinic. MHCC had the old structures on the property demolished and applied to the Town of Saratoga for a Building Permit.
The Building Permit application did not meet the Town zoning regulations. It was short 14 parking spaces and did not meet the required setbacks from the streets and neighboring properties. Linda and her neighbors, by Town code, should have been legally notified, and asked for their agreement (by signatures) expressing their “Ok” with these exceptions. Why? Because their lives and property values are impacted. Because they had reason to rely on Town Code to protect them from unanticipated building in their neighborhood, without due public action.
Linda is seeking a restraining order through the courts to prevent the construction, because the Building Permit is defective. She is asking that the MHCC conform to the zoning laws and that the Town of Saratoga conform to its legally defined public process.
Why do you care?
Linda is 75, has lived across the street from this intended construction for 11 years. She has pets and regularly shares her home with her 24-year-old grandson and 2-year-old great grandson. She is now faced with her street being the parking area for this new business building, as well as her open space (view) being reduced.
