After sharing this story on Facebook, I've had overwhelming feedback telling me to start one of these for support. THANK YOU for coming along side us in this. I never imagined the amount of debt required just to protect my kid, but I'll sell every last thing I have if I need to. This is only a fraction of where we're at with things, but the goal would be a tremendous weight off from that. We appreciate all the support for Miles, as you start to feel alone when the system is failing you.
Here's what happened and why I'm starting to think that my 9 yr old son (Miles) will once again be placed back in harms way- with people who refuse to treat him for his medical conditions properly (ADD, Autism, and a bed-wetting disorder) and instead discipline him for those parts of who he is.
On Aug. 7th, I picked my son Miles up from his mom’s boyfriends’ house they’d been living at for about the 9 months prior. We currently have split joint custody. The guy came to the door telling me Miles had been sick that morning but they didn’t know why. Next, he had Miles show me abrasions all over his chest from what I thought would’ve been a bike accident. However, the guy laughed and said it was from nights prior while playing what he called “The Tickle Game.” He’s told me about this game before, and I remember specifically telling him it’s fuckin' weird and to stop doing it w/ my kid. It’s where Miles would lay on his back w/ his arms down to his sides. The guy (large) would then kneel, straddling Miles poking him in the chest/sternum repeatedly. Miles’s mom told me she was sitting right there while it happened and didn’t see anything wrong with it ("messing around") at the time- equally disturbing to me. The guy told me he’d done it for a longer period of time that night “because Miles wanted 10 candy bars instead of 3” and didn’t realize his nails were so long. Hence all the scratches. Miles told me later that he tried to get him to stop but couldn’t breathe enough to get the words out.
I saw these marks, along w/ bruising on his neck and marks on his butt. He told me he didn’t know what those were from though, and I thought it was weird he was so quick to specify. Miles had his head down and looked completely uncomfortable. I started shaking inside because I’m good w/ 2+2. We left not saying another word to him (I'm sure my body language spoke for itself) and I got about 2 blocks before I asked Miles if he knew why his butt was bruised. He immediately started crying and said “(name) spanked me for peeing in the bed.” I hit the brakes and turned around. I told Miles to stay in the car and confronted the guy again, asking why he was lying to me about the marks, etc etc. He was acting arrogant and that’s when I almost did something I’m now wishing I had, but I started to walk away talking about how I’d be calling the cops. That’s when his story changed. He then said he “spanked him for ‘lying’ about peeing in the bed.” First off-not his kid. Second-it’s a known medical condition this man had given Miles the medicine for. For months! So I left again before my brain shut off.
I called the Cops, worked w/ Project Harmony, etc. CSI came to take pictures of Miles w/ his pants down in our apt. and he was interviewed by all kinds of people. I filed a protection order against the guy for Miles and I, which has been active/in place since then BUT is still awaiting a hearing as it keeps getting postponed by his attorney.
The hearing for the charges I filed for criminal child abuse via neglect and disturbing the peace was held Dec 4th. The city prosecutor apparently thought a $250 fine, and disturbing the peace was sufficient justice for what he admitted to doing to Miles and what we had sufficient evidence for. They cancelled the trial and cut him a deal. The guys’ Dad is a sheriff. Just sayin.
Miles’ mom doesn’t think the guy did anything wrong while remaining by his side at all this court stuff, and is planning to move back in with him if the order doesn’t go through. (Hearing date is TBD)
So that’s where I’m at. Lawyers, criminals, and $$$$ OH MY!!!
