Save Dr. Vilasini Ganesh

I am the brother of Dr. Vilasini Ganesh, who is now serving a 5 year prison term and is accused of filing “false insurance claims.”

The mistake she made was asking for the substantial monies owed to her by these very same medical insurance companies and then threatening legal action when her requests were ignored.

Instead, the insurance companies turned it completely around, accused her of insurance fraud and then defrauded her. They used the Federal government and manufactured evidence to prosecute her and not only avoid payment of what they owed her but consequently avoid her legal action as well.

It subsequently became known that the government prosecutors, wittingly or unwittingly, presented fraudulent evidence of the insurance fraud they accused her of. The spreadsheet evidence of fraud that was used to convict her was not related to her practice. It was from another practice altogether.

While the government prosecutors later agreed that the spreadsheets were wrongly presented, they blamed the doctor herself for not raising this before or at the trial. The problem was, the trial lawyer who represented Dr. Vilasini completely ignored the data, despite the fact that he took money to hire experts to check the accuracy of the data. We found out afterward that these experts were never hired. She was convicted on this false and fraudulent evidence.

At present Dr. Ganesh is imprisoned at FCI Dublin, California, the only chance that now remains is appealing to the courts under a Habeus Corpus appeal 2255 and laying out the consequences of how this manufactured evidence affected her trial's verdict.

Dr. Vilasini Ganesh was a dedicated Physician, who cared so much for her patients and a caring mother for her children. She was also the caretaker of her mother who is now 83. She is the sweetest person that anyone could have met. It's really sad, and at the same time frightening, that she has been imprisoned due to such an injustice. We are trying hard to right this wrong and erase this stain on her reputation.

Making matters worse, being a vegetarian, she is unable to eat the food provided in the prison camp- even with the meat removed. She has been forced into surviving on food that has expired. We are struggling to help her from the outside by continuing to appeal the case.

Like any of you, Dr. Ganesh worked so hard to earn her medical degree, worked overtime during her residency, and worked day and night to care for her patients. She fought to get the money that was legitimately owed to her practice. But instead of paying her what they owed, these same insurance companies used the government and the court system to falsely prosecute her. The court system completely failed her. With a new judge on her case, we are hoping to make the final appeal and exonerate her. All we are asking is for an evidentiary hearing where we will have the opportunity to prove that the spreadsheets used to convict her were from another clinic that had nothing to do with her billings or her practice. Something that everyone now agrees as fact.

We have paid over $250k to her lawyers at different stages thus far from the family resources including me and my mother’s savings. We are exhausted and seeking help with the last $25k that’s due to be paid immediately to the appeal lawyers and their Washington DC law firm and who have diligently assumed the case and are experts in 2255 Appeals.

We were able to collect $50k from friends and family to pay the due amount to the current lawyers. We need help to raise the last $25,000 needed to support the case.

Once this case gets an evidentiary hearing, and we can reverse the judgement, it will set a precedent in the court system that will help stop insurance companies from using false spreadsheet evidence to convict any doctor ever again. This could happen to anyone, any doctor that depends on insurance reimbursements for their livelihood. This could happen to someone you know. This happened to my sister.
