Utrechts kraakpand aan de Reactorweg in Lage Weide dreigt ontruimd te worden voor een studentenfeest van Corporale studentenvereniging USC. Eigenaar De Waal BV probeert zo niet alleen de 25 bewoners op straat te zetten, maar ook een einde te maken aan alle sociale activiteiten die de bewoners daar al anderhalf jaar organiseren.
Maar er is nog hoop, als we voldoende geld bij elkaar kunnen rapen zal een rechter in mei deze zaak herzien.

De situatie
Een week geleden kregen de bewoners van het kraakpand aan de Reactorweg te Utrecht van de rechter te horen dat ze ontruimd worden. 25 mensen worden op straat gezet omdat het Utrechts Studenten Corps in het pand een feestje wil geven.
Omdat de bewoners het onacceptabel vinden dat een studentenfeest belangrijker wordt gevonden dan het recht op wonen en leven van een grote groep mensen (en honden) is er een kort geding aangespannen om dit te voorkomen. “Er wonen hier allerlei soorten mensen. Sommigen wonen hier noodgedwongen, omdat ze geen andere woonplaats kunnen krijgen. Voor anderen is het een meer een ideologische keuze.” Meerdere bewoners vertelden tijdens de eerste zitting dat ze op straat komen te staan als ze direct weg moeten. Een jonge vrouw legt uit; 'Ik sta tien jaar ingeschreven bij Woningnet, maar kan geen woning vinden’.
Utrecht zit in een enorme woningcrisis, en de wachtlijsten groeien dag bij dag. De gemeente slaagt er niet in genoeg betaalbare woonruimte te creëren. In plaats daarvan worden hele wijken gesloopt en vervangen door peperdure huurwoningen. In Lage Weide staat één op de vijf kantoorpanden leeg² en nu heeft het Corps uitgerekend dáár een kantoorpand gekozen waar 25 mensen zichzelf in hun basisbehoefte voorzien. Na het feestje komt het pand hoogstwaarschijnlijk weer leeg te staan. Vastgoedbedrijf De Waal wil door het tijdelijke contract met de USC van de bewoners af komen.
De bewoners geven aan dat de huidige woningmarkt amper mogelijkheden bevat om op zo’n maatschappelijke manier te leven; 'Mijn ideale leefomstandigheden zullen nooit gerealiseerd worden in een rijtjeshuis’, Verschillende bedrijven uit de omgeving steunen de krakers en hun sociale functie in de omgeving.
Vanwege de coronamaatregelen is het sowieso nog maar de vraag of de festiviteiten door kunnen gaan. Ook zijn de vergunningen nog niet aangevraagd, terwijl er nog steeds een grote hoeveelheid vergunningsaanvragen bij de gemeente ligt voor het geval er weer evenementen mogelijk zijn, betoogde hun advocate.

Achtergrond
Eén van de bewoners vertelt wat over hun pand aan de Reactorweg:
‘We staan altijd open voor mensen met eigen ideeën over de invulling van deze plek; mensen kunnen aankloppen als ze iets nodig hebben of mee willen doen met projecten. Voor de corona-uitbraak kookten bewoners wekelijks voor kennissen en buurtbewoners met gerecycled weggegooid voedsel of groente uit onze moestuin. Ook was er een weggeefhoek waar mensen tweedehands spullen konden achterlaten of meenemen. Verder hebben we een muziekstudio, en wordt er yogales geven en Franse taalles.
Ook mensen die door omstandigheden dakloos zijn geraakt kunnen tijdelijk bij ons logeren, zodat ze een basis hebben van waaruit ze op zoek kunnen naar nieuwe woonruimte. Er is eigenlijk altijd wel wat te doen of te klussen, waarbij er ook altijd veel ruimte is voor gezelligheid.’
Dus hier staan we dan; De studentenvereniging aan de ene kant, die dagenlang wil feesten in het pand in Lage Weide. Aan de andere kant de 25 bewoners die diverse activiteiten organiseren.

Wat kun je doen?
Omdat een groeiende groep mensen zich tegen de ontruiming uitspreekt hebben de bewoners besloten het er niet bij te laten zitten. Ze gaan in hoger beroep. Ze hebben dit platform gecreëerd om hun verhaal te delen en geld op te halen voor de rechtszaken. Iedereen die wil, kan een donatie kan doen om het hoger beroep te betalen.
Acties die jij kunt ondernemen om deze mensen te helpen:

Financiële transparantie
Laten we beginnen met het feit dat als de bewoners de rechtszaken winnen, alle donaties terug betaald worden aan de donateurs (transactiekosten van het platform in mindering gebracht).
Echter als de zaken worden verloren dan komen de kosten voor rekening van de bewoners. De Reactorweg bestaat uit meerder adressen en meerdere woongroepen, daarom worden er twee aparte rechtszaken gevoerd. De kosten voor de eerste rechtszaak zijn al gedekt door de bewoners zelf. Maar voor de tweede rechtszaak en om in hoger beroep te kunnen gaan, is meer geld nodig. Hieronder worden de zaken en kosten op een rijtje gezet.
Rechtszaak 1: Kort geding
Vorige week heeft de zitting van het kort geding voor deel van het pand (adressen) plaats gevonden waarna de rechter heeft besloten dat deze woongroep niet voldoende bewijs en belang zouden hebben bij het pand en dat een lustrumfeest belangrijker is. De gehele uitspraak is te lezen op deze website.
Kosten voor deze zaak zijn: € 1683,-, dit is al gedekt door de bewoners zelf.
Rechtszaak 2: Hoger beroep
De bewoners steken hun handen uit de mouwen en strijden tegen de speculatie van vastgoedeigenaren in een hoger beroep. Datum waarop de zitting plaatsvindt volgt nog.
Kosten voor deze zaak zijn geschat op: € 2600,- (doel 1)
Rechtszaak 3: Kort geding
Op 12 mei vindt de zitting plaats voor een woongroep aan de andere kant van het terrein. Bewoners van deze woongroep wonen grotendeels buiten in wagens.

A squat in the city of Utrecht at Reactorweg in the district of Lage Weide is being threatened with eviction. The reason? The Utrechts Studenten Corps (Utrecht Student Association, USC from here), a Fraternity, wants to throw its 77th annual “lustre” party in the 3 squatted buildings that house 25 people and numerous social, cultural, and political initiatives. To make such an eviction during the COVID-pandemic and a housing crisis in Utrecht, the students are essentially helping the owner evict the 25 squatters, putting them on the streets.
But we still have hope! If we manage to raise sufficient funding we can initiate a higher appeal, in which other judges will revise the case.
The situation
A court ruling last week decided that the people living at the Reactorweg in Utrecht will be evicted to facilitate a week-long party organized by the USC.
The living groups think it is unacceptable that a student party gets precedence over their right to proper and affordable housing. Consequently, the living groups went to court to prevent this from happening. “The people living here are very diverse. Some live here as there are no alternatives, others live here more out of ideological reasons.” In the court case, the squatters emphasized the urgency of the case and said they will be homeless if the eviction continues. “Some have applied for social housing a decade ago and still can’t find proper housing,” one of the defendants explained.
Utrecht knows there is great housing crisis. Over the last decade, the municipality has not succeeded in providing or facilitating sufficient, affordable housing. Rather, they choose to demolish already existing neigbourhoods in order to make place for expensive housing. Therefore, it is crude to see that the USC chooses the house of 25 people to throw their party, while In Lage Weide specifically one out of five offices buildings are vacant.² Odds are high that the buildings will be left vacant or demolished after the party. And the owner does not have any building plans prepared. The living group believes it is the goal of the owner, Vastgoedbedrijf de Waal BV, to evict them by means of the USC.
Other members of the living group explain that the housing market does not provide enough alternatives in which people can experiment with creative forms of communal living and working. “My ideal way of life will never be realized in a casual house,” one of the defendants explained. In the court case, they showed declarations of support from neighbours to prove the social value they have in the area.
The squatters seriously doubt whether the student party can take place in the first place, as the Netherlands are still subject to extensive and strict corona measures. The fact that the USC did not yet even apply for the necessary permits, while the municipality already has to work through a big pile of applications, says enough about the precariousness of the event, explained the lawyer.

One of the inhabitants explains about the life at the Reactorweg:
“We are always open to people that have their own ideas about how to organize and arrange the spaces in this place; people can always come by if they are in need or want to be involved in ongoing projects. Before Corona broke out, we cooked large dinners for donation basis (called eetcafe) for acquaintances and neighbours, using saved food or vegetables from our own garden. We also have a free shop where people can find or donate clothing, books and other objects, plus we have a music room, we organize yoga lessons and language classes. People who have become homeless can (and have) temporarily stay(ed) at our place. In this way we help them finding another place to live. In short, there is always something to do or build and we have created a very nice space for experimental, social, cultural, and political initiatives.”
So here you have it: On one side is the USC, that wants to throw a week-long party in a building in Lage Weide; and on the other side, the 25 inhabitants, organizing a variety of social, cultural, and political initiatives.

Financial transparence
Let’s start with the good news: if we win the court case, all donations will be returned to the donators (minus the transaction costs charged by the platform)!
However, if we lose the cases this means we will have to pay all the costs, including the costs of the state’s lawyers. As the Reactorweg consists of multiple buildings and groups, there are two separate court cases. The costs of the first court case have already been covered by one living group. For the second court case and the higher appeal in the first court case, we will need more money. Below we will explain how the costs are divided:
1st Court case
Last week the court case for the eviction of the office buildings took place. The judge decided that the living group’s housing rights are less important than the owner’s right to facilitate a student party in times of a COVID-pandemic. The costs of the first case: € 1683,-, which has already been covered by one living group.
2nd Court case: Higher appeal
The living group has decided to take on the battle and fight the power of the owner, a real estate speculator, in a higher appeal. The date for the higher appeal has yet to be decided.
The costs for the higher appeal have been estimated to be € 2600,- (goal #1)
3rd Court case
On the 12th of May another court case will take place. In this court case the judge will decide on the eviction of the terrain where people live, including a warehouse.
The costs for the second court case will be € 1683,- (goal #2)
