We are raising funds to hire a lawyer who can draw up documentation to legally protect us from any potential negative impact or damage to our homes resulting from the proposed building plans affecting 513 Oriole Drive, 1270, 1272, and 1274 Grove Road. Top priority concerns related to this include but are not limited to:
1.) Storm Water Runoff that may cause issues with our basements flooding or our roads. Based on our past experiences with tree removal at high elevation in this area, this should be a potential concern for all homes who are below grade of the aforementioned addresses.
2.) The quality of our well water for those who have wells. Part of the legal plan may be to have our wells tested before construction begins and have the results documented as proof that can be used in case our water becomes contaminated from the surrounding building. Or if the proposed draining bins actually work TOO well and dry up our streams and well systems.
3.) With all the dirt that will have to be moved, we are concerned about where it will be put and the structural integrity of the homes closest to the build with the heavy machinery coming through.
4.) Legally preserving the lands on the plans designated as riparian zone so they can’t also be built upon at some point in the future by the owners of the new homes or anyone those new owners may attempt to sell that land to.
5.) Addressing (if possible) the Simmons land and preventing additional development from branching off into those thirteen acres resulting in further tree loss, additional homes, building disruption and traffic.
We also have an interest in looking into the zoning approval process for combining the four lots in question and see if we can’t stop the entire build from there or limit the builders to fewer houses. We accept that some building will likely happen on this land, so the purpose of this fund is to protect our homes from as much of the potential negative impact as possible BEFORE the damage is done and we are helpless to hold these builders or the township liable.
In the event that we do not raise enough funds to move forward with legal action aimed at achieving these protections OR a lawyer advises against us moving forward we will refund all the GoFundMe donations to the respective parties.
