A new bill in Pennsylvania, House Bill 1972, threatens to destroy the public adjusting profession and strip away vital protections for property owners across the state. Pushed by the insurance department and carrier lobbyists, this proposal is being disguised as “consumer protection.” But make no mistake — it’s anti-consumer, anti–small business, and pro–insurance company.

HB 1972 (What’s in the Bill)
  • Cap all public adjuster fees at 15%, regardless of claim size.
  • Cap catastrophic losses at 10%.
  • Ban contractors from paying adjusters.
  • Extend the cancellation period to 15 business days, giving insurers time to pressure homeowners into backing out of valid contracts.
  • Allow carriers to speak verbally to clients without their public adjuster present.
  • Add layers of unnecessary red tape and restrictions that will cripple small adjusting firms.

At first glance, it sounds like reform. But here’s the truth:
  • Over 92% of all property insurance claims in Pennsylvania are under $25,000. Under this cap, no professional public adjuster could afford to take those smaller claims — leaving families and small businesses alone against billion-dollar insurance companies.
  • That means billions of dollars in underpaid claims every year, while consumers are left to fend for themselves after fires, floods, and storms.

  • Homeowners and small business owners who won’t be able to get professional help when they need it most.
