Recently our community of Kennedy Township PA was made aware that the Township commissioners had requested bids to sell a parcel of land that is part of Fairhaven Park. Fairhaven Park was deeded to Kennedy Township in 1951 strictly and specifically for Parks and Recreation. Making the Park a donated and dedicated property.
A petition was circulated by our community and had close to 1200 signatures and members of the community (in a standing room only crowd) attended the first meeting to express their displeasure with destroying the only green space left in our small community.
The Donated and Dedicated Property Act was established to prevent municipalities and the states from doing exactly what our Township officials are trying to do.
It appears that our Township officials are trying to say that everything they are doing is legal but we know based on the DDPA Act and the Township's trustee duties under the Environmental Rights Amendment of the PA Constitution that they are in violation of a number of laws and they should Cease and Desist.
Since time was of the essence we retained an Environmental Legal Attorney at a reduced fee and were willing to pay the initial expenses. He has sent the township a Demand letter to Cease and Desist and to date they have not responded. Knowing this fight would cost us approximately $10,000 if it had to go the entire way we felt we had no choice.
Fairhaven Park has been utilized by our community members and members of outlying areas for sports, family reunions, graduations, afternoon picnics and social gatherings for more than 50 years. And it could be so much more for our future generations.
We now have over 1300 members and are asking that if every member and/or friends of members or even past and present residents donate $5-10 each or more if able to, to support this cause, we will have what we need to fight this.
They are hoping that we will stall out and they will just bulldoze over the only green space that protects our park and future park expansion opportunities. Over the years funds had been donated by government officials, volunteers in our community held fundraisers to continue to beautify our park but were often met by our officials with road blocks and excuses. It is time to let them know this is our park! Please help by donating to SAVE OUR PARK!
