UPDATE - On April 29, 2024 the OLT ruled in our favor!!
The OLT denied Crystal Bay Cottage’s appeal of the Town’s denial of their Zoning By-law Amendment application for the 4409 Erie Road Project!
Their grounds were: "In summary, the Tribunal finds the ZBA does not conform to the Town OP and therefore does not constitute good planning."

First and foremost, Thank You to everyone who has contributed to the fund to fight the 4409 Erie Road development plan.
The proposed development of the 4409 Erie Road property, with eight new homes on the property, is an existential threat to the way of life in our community. If allowed, this would set a precedent that could transform the entire beachfront. Developers would snatch up properties and build, build, build. Zoning is meant to protect neighbors from exactly this threat, and a developer is asking that it be ignored for his profit.
Our fight centers on what is good planning and what the Town of Fort Erie should and should not allow. The Town’s Council and staff have heard the facts and ruled against Mr. Keenan, but he is appealing their decision. With your help, we are supporting the Town and stand ready to do whatever is necessary to stop him.
The remaining battle has already begun. The Ontario Land Tribunal (OLT) hearing started today. It is scheduled to continue through the end of the week, at least.

Budget Moving Forward
We anticipate the budget for the remaining OLT process will be significant. Our team of legal, urban planning, engineering, and environmental will be attending the virtual OLT five-day hearing, presenting evidence and cross-examining opposition witnesses. I believe a conservative estimate total is US$110,000. Of course, any unused funds will be ratable refunded.
