Background Update (March, 2022)
This GoFundMe initiative was established in 2019 to fund Plaintiff legal costs associated with a lawsuit filed to validate that any Park Crossing homeowner can access the Little Sugar Creek Greenway via our neighborhood streets using platted and recorded pedestrian access easements (PAEs) in the Park Crossing neighborhood. A judge required that all Park Crossing homeowners join the lawsuit as Plaintiffs, Default Defendants, and Defendants (those with the platted and recorded PAEs on their property).
In the spring of 2021, thanks to $76,725 in GoFundMe neighbor contributions, legal settlements were reached with all but one Defendant (Worthington). A Judge subsequently ruled that the PAE on the Worthington property is, in fact, valid for use by all Park Crossing homeowners to access the Greenway. Unfortunately, the Worthingtons recently filed an Appeal of the Judge’s ruling, and also filed a new Motion to grant injunctive relief preventing the use of any greenway access points in our neighborhood
