Loren Tomschin is a crazy talented artist, amazing tattooist, and someone who is equally comitted to bettering his community as he is creating brilliant artwork. For many years, he worked with local disabled youth, teaching and building them up in ways only a strong and humbled leader, passionate about his commuity, could. 

As of 2017, Loren's fight for his partental rights and to no longer be alienated from his daughter has been going on for almost 12 years. What started as a bright future, full of love and looking foward to fatherhood after a 5 year relationship with his (now ex) girlfriend, who he came to love deeply and call wife, quickly turned into a brutal court battle for a 3-year-old Nyalee's right to continue to see her father. A little girl who quickly became "Daddy's Girl" from the very start.

The desperate accusations from the mother began 3 years after Nya was born. The first was questioning Loren's paternity - she wasn't sure he was actually the father. When a paternity test proved he of course was the father, the desperate attempts to remove him from the picture continued. Accusations of abuse and mistreatment were used to lock him out of his daughter's life - the allegation of "inappropriate touching" while Loren was changing his daughter's diaper. Accusations that Loren fought steadfast to disprove - bankrupting himself and being forced to close his successful tattoo business. Accuations that he was NEVER charged or convicted with. And the case was then closed. But still... Loren continued to be alienated from his daughter. Because the accusations existed, the simple gesture of delivering Christmas presents to his daugher was enough for the court to lock him out of his daughter's life with a maxium 5 year restraining order. Loren went back to court to fight the order....but at that point could not afford to take it through the Court of Appeals. 

During those 5 years, Loren abided by the court's order and waited until the time had passed to start the reunification process with Nya - a daughter who turned 12 years old, who as a result of the court process, he hadn't had any contact with since she was just over 3 years old. After those 5 years were over, Loren again picked up the fight in 2016 to reunifiy with his daugher, and retained a new laywer... only to find out that just 2 years into that 5 year stay-away order, his ex and her new husband had filed for abandoment, stipped him of his partental rights, were able to process a formal legal adoption with the step-father, and changed Nya's name to Victoria. Loren was beyond crushed. 

As the new laywer looked further into how this could've possibly happend, knowing that years of restraint CANNOT COUNT toward abandoment under the law, it became clear that the ex and her new husband did not follow proper protocol when filing the necessary legal paperwork for proving abandonment. Not only was Loren never made aware of the proceedings, but it is also REQUIRED BY LAW to serve notice to immediate family members of the hearing to establish abandoment and teminate parental rights. Loren's immediate family - his mother, father, step-father, step-mother, and sister - were NEVER served with such notice. Thus making the abandonment, and subsequent adoption, ILLEGAL. 

Loren is now fighting for his LEGAL right to be his daughter's father. His fight for his parental rights is now focused on OVERTURNING the court's ruling of abandoment, based on NO service of the required court notficiations. The overturning of this ruling would then nullify the adoption of Loren's daughter by her step-father.

Case law states that if there is no service, the court has no jurisdiction. And without jurisdiction, there is no judgement. Though the evidence is strong, and case law clearly is clearly in our favor, it will still be an uphill battle to show that the court's own rules were not followed, and it MUST overturn it's own ruling.

Loren's laywer has already put in hours of time disecting this case, researching case law, and submitting the RIGHT legal paperwork in order to right this MONUMENTAL wrong.... a wrong that has ripped a man's life apart for over a decade. Many of these hours she has not been paid for. She continues working on Loren's behalf, beause she belives in this case.  The first hearing will be held in mid-March, 2017.

We are asking for help with the legal fees, so that a father can begin to be reunifed with his daughter. A daughter he has only been able to see grow up in photos and and from afar, and a daughter he has been painfully separated from for far too long. 

Loren is typically a very private person when it comes to personal matters, not wanting to burden anyone else. But at this point he can no longer afford to be private. Any amount given would be so incredibly meaningful to him.
