On February 2nd, the Town Council held a Quasi-Judicial Hearing to approve a 12 pump, 24-hour 7-Eleven fueling center under a Neighborhood Commercial designation.

A quasi-judicial hearing is not a town hall.

It is a legal proceeding. Decisions must be based on competent substantial evidence.
Objections must be preserved.
The record determines what survives on judicial review.

Most residents appeared without legal representation.

The applicant had counsel.
The Town had counsel.
Residents did not.

Why This Matters

The applicant's own traffic data shows approximately 76% regional pass-by traffic.

The proposed
design includes:
  • Twelve fueling positions
  • Large canopy infrastructure
  • 24-hour operation
  • State Road frontage orientation


The legal question is whether a regional-scale fueling operation satisfies the standards of a Neighborhood Commercial designation and the Town's Conditional Use criteria.

That is a legal determination - not a political one.

The March 4 Deadline

Under Florida law, any challenge to this approval must be filed within a strict deadline.

We have until March 4 to retain experienced land-use counsel to review the record and determine whether judicial review is warranted.

Without counsel, the approval stands.

With counsel, the process can be evaluated under proper legal standards.

What This Fund Does

We are raising $25,000 to retain a Florida land-use attorney to:

  • Review the full hearing record
  • Evaluate whether the approval is supported by competent substantial evidence.
  • Identify procedural or legal defects, if any
  • File a Petition for Writ of Certiorari if warranted
  • Seek remand for a properly conducted rehearing if grounds exist

Emails have been sent to three independent land-use attorneys. We are awaiting responses regarding availability and retainer requirements.

The $25,000 goal reflects a typical initial retainer range for certiorari review and related proceedings.
