Hello, my name is Benjamin and I'm the father of a wonderful 3 year old named Miles. He, my wife and I moved to Berlin, Germany in January 2024 from New Jersey, USA, and have become settled in the city. Miles is part of the school system, he has German citizenship, he speaks some German, and he loves the trams, U-bahns and S-Bahns.
In October 2024, my wife decided she wanted to separate. I was forced to leave our family home and seek my own apartment. I complied with all requests and referred our case to the Jugendamt (child services), as I was being denied access to him. 10 minutes a day, in the mornings. Through the Jugendamt, the custody became more equitable, which my wife clearly was not happy with.
December 29th, 2024 was Miles' third birthday. He spent the day with his grandparents and me, eating cake and playing with his new toys. He said goodbye to his grandparents, I took him on his favourite bus back to my wife's apartment, and I said goodbye to him.
On December 31st, I received a text from my wife, saying that she had returned to the USA with Miles and they would not be returning to Germany. They had flown the day before.
I did not give her permission to leave the country with him. This is a clear violation of the Hague Convention, which both the USA and Germany are a party to. I have submitted a police report, with potential for Interpol to become involved, and I have also filed through the official channels between the USA and Germany. The law is on my side, but I cannot afford the 3.5-10k Euro I have been quoted by various law firms, if my wife has already "lawyered up" in the USA.
Please help me bring my son back home. My and my parents fear we will never see him again.
