In 2018, our family's world was drastically altered when our father, Robert Carr, suffered a devastating stroke. His cognitive and physical health rapidly deteriorated, and in the following years, he faced the debilitating challenges of kidney failure and Uremia. Despite these hardships, he remained resilient, determined, and full of love for his family.
During this trying period, our family fell victim to a fraudulent and predatory lending scheme that preyed upon our vulnerabilities and exploited our father's illness. It was a nightmare we couldn't have foreseen, and it exponentially compounded the emotional and financial burden we were already carrying.
The situation becomes even more heart-wrenching when considering that this illicit loan transpired in September 2020, amidst the bleakest days of the COVID-19 pandemic quarantines. At that time, our father, already grappling with severe cognitive health issues, found himself in a heightened state of vulnerability. It is my opinion that the fraudsters intentionally chose this period in time to exploit our family.
Tragically, in January of 2022 the burden of his failing health became too much and he passed away peacefully in his sleep on the morning of the 14th. His death left a void in our lives that can never be filled, but it also left us with a clear mission: to seek justice for the suffering he endured as a direct result of the defendants deplorable actions.
My sister, Mallory, and I, Chris, are determined to fight for our father's memory and hold those responsible for this fraudulent lending scheme accountable. We have dedicated all of our efforts and finances into a complicated civil lawsuit. The intricacies of the deception within the loan are multifaceted, involving occupancy fraud, gross negligence, as well as numerous conflicts of interest. Notably, we have also identified fraudulent charges exceeding $30,000 for purported home repairs that were never intended to be fulfilled. It is crucial to clarify that our concern extends beyond a mere lamentation of the loan's unfairness. Instead, we assert that the entirety of the loan, from its foundation, is characterized by fraudulent elements and is indefensible in its current form.
But it wasn't just about the financial implications; this scheme affected our father's end-of-life care. He was unable to make necessary disability-related repairs to his home, leading to needless physical suffering and undue financial distress. His last days should have been filled with comfort and dignity, but they were marred by the actions of these fraudsters. As if that weren't enough, the illicit mortgage led to the improper foreclosure of our family home, displacing our disabled mother, Cecilia, and pillaging all that was left of our father's humble estate.
We are turning to the power of the community and the kindness of strangers to help us in our fight for justice. We've now retained the right attorneys to guide us through the litigation as the legal battle ahead is formidable, and the financial strain is overwhelming.
