We, a collective of owner-occupier leaseholders residing in flats within this development, find the absence of key elements within the legal framework safeguarding leaseholders quite noticeable. Moreover, there's a concerning trend where certain entities exploit leaseholders, particularly owner-occupiers, to significantly benefit property developers, landlords, and property managers.
Over the past five years, the successive managements of our leasehold flats have been demanding substantial sums, mostly allocated to professional and legal fees, while neglecting the deteriorating conditions within our development. Despite our efforts to seek clarification on demanded sums and improvements in services from both the property developer and the property manager, our appeals have been in vain.
In the last six months, our attempts to gain control of the Residents Management Company (RMC), aiming for more influence over the property and its expenses, have been unsuccessful. Simultaneously, we seek clarification on the responsibility for the current boiler issue, expected to incur considerable expenses.
To hold the landlord, property developer, and property manager accountable, our only recourse is now to explore legal avenues. A solicitor specializing in leasehold regulation has quoted an initial fee of £1000 to review our leases and the RMC association rules. They will produce a comprehensive report for all leaseholders, offering guidance on subsequent actions.
