Hello, my name is Cuauhtemoc Hernandez, and I have setup this fundraiser to help my friends Edith Carrillo and Mario Alberto Cabada with their legal fight for justice for their daughter ("S.C."), who at 3 years old was sexually abused by a close family member.

They live in Mexicali, Mexico (borders with Calexico, California and very close to Heber, California where I live) and back in November 2023, when their daughter was 3 1/2 years old, they filed a sexual abuse case against her paternal grandfather. A year later in December 2024, the judge assigned to the case dismissed it citing irregularities, dismissed information and evidence, didn’t consider requests by the prosecutors, showed inclination towards the defense and didn’t follow due process in clear violation of their daughters rights, in the end removing all cautionary measures and travel restrictions on the accused who could flee taking advantage of being a dual citizen of Mexico and USA.

Edith and Mario have since been tirelessly advocating for justice for their daughter who recently turned 5 years old. After the ruling, they filed a complaint with the Human Rights Commission and an appeal was filed by the State General Prosecutors. They also reached out to multiple local and regional news outlets and have created a Facebook Page Justicia para Camila en Mexicali (click to open) to make their ordeal known to the public and generate awareness about their case and fight, even others have commented about their own cases.

Currently, they're waiting for the appeal process to follow its due course and eventually have to go thru most, or all of it, all over again. Hopefully, this time the Mexican Justice System with its flaws and loopholes will deliver the justice that their daughter deserves.

During this part of the nightmare that has lasted more than a year, they've had to move to not be close to the accused abuser, have lost their only vehicle, attend public and private psychologist appointments for the 3 of them every other week, seek private legal advice, attended appointments with their lawyers every other week and appointments at the Center of Justice and other related organizations and offices, all of this besides doing their best to give their daughter a family life where she can make the best of her childhood while also attending kindergarten.

As you can imagine, it has also been emotionally draining, financially devastating and now they have to go thru it again. They have been fortunate and grateful to have family, friends and acquaintances support them in multiple ways during this ordeal, but now they need the support of a larger community for the coming year and the next stage of their fight.

Let me tell you a little bit about Edith and Mario, they make a living as small business owners of Revolt Café & Boutique (Facebook and Instagram accounts, click to open) their current main source of income, an alternative coffee shop, venue and record shop that they established in 2020. With their limited savings and imagination, a true brick and mortar hole-in-the-wall spot was born as a result of the post-pandemic financial catastrophe. They managed to keep their doors open using up their available resources, even selling and auctioning assets from their personal record collection.

With your support, contributions and shares of this fundraiser, you will help Edit and Mario continue their fight on behalf of their daughter, continue taking care of their mental health as a family, keep their way of living open and running, and most importantly, stay hopeful that they can eventually turn the page on this terrible chapter of their lives.

I am the parent of an 18-year-old with a developmental disability; individuals with developmental disabilities are at a higher risk of abuse, particularly abuse from someone they trust or provides care. Although family circumstances are different, as a parent I care about their fight because Edith, Mario and most importantly, their daughter deserves justice, and they need to be able to trust again.

Hola, me llamo Cuauhtemoc Hernandez y he creado esta campaña para ayudar a mis amigos Edith Carrillo y Mario Alberto Cabada en su batalla legal buscando conseguir justicia para su hija ("S.C.") que a los 3 años de edad fue victima de abuso sexual por parte de un familiar cercano.

Ellos viven en Mexicali, Mexico (frontera con Calexico, California y muy cerca de Heber, California donde yo vivo) y el pasado mes de noviembre de 2023, cuando su hija tenia 3 años y medio, interpusieron una demanda por abuso sexual en contra de su abuelo paterno. Este pasado mes de diciembre de 2024, la juez asignada al caso procedió a desestimarlo citando irregularidades, desestimó información y evidencia presentada, no consideró peticiones de la fiscalía, mostro favoritismo hacia el acusado y no se apegó al proceso en violación de los derechos de su hija. La juez retiro entonces las medidas cautelares y restricciones de viaje al acusado quien puede salir del país al contar con doble ciudadanía mexicana y estadounidense.

Edith y Mario han abogado incansablemente por justicia para su hija que recientemente cumplió 5 años. Después de la decision de la juez, interpusieron queja con la Comisión de Derechos Humanos y una apelación del caso fue solicitada por la Fiscalía General del Estado. También decidieron contactar a múltiples medios locales y regionales y han utilizado redes sociales para hacer de conocimiento de la comunidad de su caso y lucha. Abrieron una Página en Facebook Justicia para Camila en Mexicali (click para abrir) para compartir sobre su situación e incluso otras personas han comentado sobre sus propios casos de injusticia.

Actualmente están dando seguimiento a su caso dado que el proceso de apelación sigue su curso y eventualmente tendrán que pasar de nuevo por la mayor parte, si no es que por todo el proceso. Tienen la esperanza de que en esta ocasión se hará la justicia que su hija merece a pesar de las fallas y deficiencias propias del sistema de justicia mexicano.

Durante esta pesadilla de más de un año, tuvieron que cambiar su residencia para no estar en cercanía del acusado, perdieron su único vehículo, los tres han asistido a consulta pública y privada con psicólogo cada ciertas semanas, han recurrido a asesoría legal privada, asistido a citas con sus abogados cada ciertas semanas y a citas en el Centro de Justicia, así como otras organizaciones y oficinas relacionadas, todo esto a la vez que hacen lo mejor que pueden por darle a su hija una vida en familia donde puede disfrutar su niñez y continuar asistiendo a clases de kinder.

Como pueden imaginarse, todo esto ha sido desgastante emocionalmente y devastador económicamente, ahora tendrán que vivirlo de nuevo. Han sido afortunados y agradecidos de tener familia, amigos y conocidos que apoyan en diferente manera durante esta odisea, pero es claro que necesitan el apoyo de una comunidad mas amplia para lo que se viene este año y la siguiente fase de su batalla legal.

Les platico un poco sobre Edith y Mario, son pequeños empresarios propietarios de Revolt Café & Boutique (cuentas Facebook e Instagram - click para abrir) que es su fuente primaria de ingreso, un café alternativo y tienda de discos que empezaron juntos en 2020. Con imaginación y algo de ahorros, abrieron un establecimiento de la nada como resultado de la pésima economía pos-pandemia. Lograron mantenerse abiertos usando todo los recursos a su disposición, incluso vendiendo y subastando material de sus colecciones personales.

Con su apoyo, contribuciones y ayuda compartiendo esta campaña, darán un respiro a Edith y Mario para que puedan continuar luchando por su hija, para que puedan seguir cuidando de su salud mental como familia, mantener su forma de vida operando, y sobre todo, tener la esperanza de dar por terminado este terrible capítulo en sus vidas.

P.D.: Soy padre de un hijo de 18 años con capacidades diferentes; las personas con capacidades diferentes corren un mayor riesgo de sufrir abuso, particularmente de parte de alguien en quien confían o que provee cuidados personales. A pesar de que hay diferencias en las circunstancias de familia, como padre me importa su lucha por que su hija merece justicia y como familia necesitan recuperar su capacidad de confiar.
