Are you worried about the HPPOA Board skimming off money collected for road maintenance and using the money for whatever they want, in blatant violation of the Bylaws?
Are you concerned about the HPPOA Board blatantly ignoring deeds on land that are restricted for the use for schools, playgrounds and recreation, and instead building a parking lot with 2,000 mailboxes on each of four pieces of land?
Do you want almost a million dollars of your road maintenance fees to be used for installing and maintaining these mailboxes, in direct violation of the Bylaws?
Do you care about the HPPOA telling you that we are a “planned community” in the same way that a condominium project or timeshare is, and inflicting new rules that don’t apply to our agricultural community under state law?
Do you want a homeowners’ association who will be able to tell you how to use your land, what color to paint your house, and what and how many animals you can have? This is just the beginning of the Board declaring itself a “planned community association”. As many people have correctly commented, HPP is as far from a “planned community” as you can get.
We are a group of HPP lot owners who are alarmed by the way the HPPOA Board of Directors is ignoring the HPPOA Bylaws, state laws, and deed restrictions on the land.
For the benefit of other like-minded lot owners, I have filed a lawsuit against the HPPOA Board of Directors as well as against President Kari Hoffman and Vice President Jeff Finley.
We need help with legal costs and fees!
A lawsuit alone cost over $500.00 to just to file it in court. There are also fees and costs for filing motions, copying, mailing, and taking depositions. While the HPPOA Board has insurance that will cover all of their attorneys’ fees and costs of a lawsuit, we don’t have that luxury. Every penny will come out of pocket. Let’s join forces and put the Board back in its place!!
The Board’s response to concerned members pointing out the fact that they are going against the deeds and against the Bylaws was, “We’ll take our chances”*. That’s because they know that litigation is costly, and they are betting on the fact that no-one in HPP can afford to do it. They feel they have carte blanche now to do what they want and no one will do anything about it. Let’s make sure that they are on the losing side of their bet.
