Captain’s Cove is a beautiful residential community on the Eastern Shore of Virginia. It’s called “home” to many hardworking, tight knit and caring neighbors that range from young families with children to retirees who chose to build their forever homes here.

Captain’s Cove is a homeowners association and as such, our association is run by a Board of Directors controlled by, or affiliated with the Developer. The Board makes the rules and guidelines, develops the budget, and sets the conditions for owners on how we are to maintain our properties. Now, while this all sounds well and good—and exactly how an HOA is supposed to run—members find it difficult to navigate the Cove under the long-time control of its Developer and the Developer controlled Board.

Owners did not know that when you bought a home or property in Captain’s Cove, that YOU became the developer! That can’t be right, can it? Ohhhhh….that’s right—every single, hard working owner—is required to pay for the construction of the community roads. One might ask, “Isn’t that the developer’s job to build the roads? How can it be the homeowner’s responsibility, when the community’s original property plans submitted by the Developer to the United States Department of Housing and Urban Development and the Army Corp of Engineers states that THE DEVELOPER is to bear all the costs and responsibilities to build the roads. As homeowners, we understand that it’s our responsibility to repair and maintain existing roads, NOT to build them from scratch. That’s just crazy!! Our cover photo is an example of what the Developer and BODs claim to be a road need resurfacing. There isn't even a road there! It's a dirt path that needs to be prepared for road construction!

Below is a photo of one of our roads that needs to be repaired. This is one of the areas where the developer's lot isn't protected with a bulkhead or rip-rap. All other waterfront lot property owners are required to protect their properties to avoid erosion, but this area and road built with our money is eroding into the Chincoteague Bay.



Captain’s Cove has over 37 miles of roads—and many remain unbuilt. That’s a heck of a lot of roads and a heck of a lot of money for homeowners to pay for roads. Over 3.46 million dollars of homeowners’ money to date has been used for the construction of new roads—3.46 MILLION—with millions more needed to fully complete the construction of new roads.

Instead of sitting back and complaining about the matter, seven brave owners decided to take action and fight for what’s right for owners and our beautiful community. They filed a lawsuit against the Developer claiming that the Developer did not adhere to the Settlement Agreement signed in 2012, wherein it calls for the Developer to pay $50,000 a year for 20 years specifically to build roads in Captain’s Cove.

Our reason for raising funds is straightforward. Our team that’s fighting the good fight in court against the developer suffered a defeat—yet the need to achieve a larger, more important victory over time remains. Funds are needed to appeal the Circuit Court’s decision. Cash collateral is needed to secure the bond for the appeal—and there’s a time crunch.
