Help Reunite Noah Lee Hernandez with His Father

Hello everyone, thank you for joining me on this journey of parenthood we so want to be a part of. It is with unfortunate circumstances that I am here today to request help from a crowdfunding campaign with GoFundMe in order to gain financial support in my journey of reestablishing possession and visitation of my son, Noah Lee Hernandez. This is definitely a last resort I am jumping into as I have tried to do this on my own for quite some time now. This battle has been going on since Noah's birth on November 22, 2021.

Noah's mother has always been a challenge to meet from the moment we knew of the pregnancy. The gender reveal and baby shower I was barely invited to and only allowed to have 5 family members present at, until the day he was born in deciding his name, circumcision, paternity, and necessary needs of a baby. She has tried to dictate and commandeer the days, hours, and visitation schedule I would have with Noah during his infancy. When she was not satisfied, she cut off all contact with me and my family, and this forced me to file with the Attorney General court orders for custody and visitation/child support.

Once I was able to regain visitation outside of her control, she demanded the court to establish my visitation schedule to include supervised visits from my parents because Noah was younger than 3 years of age and she feared for his safety and for his life. During this time, she would constantly request a change in meetup times, location, etc., in which I, without resistance, agreed to. This schedule lasted about 4 months before, once again, she was not happy about one of the visits. Coincidentally, on the visitation in which I was supposed to have Noah for Christmas holidays, she decided to withhold Noah and cease all communication with me once again. This hiatus in time lasted about 6 months before I could file a Motion of Enforcement to regain visitation of my son Noah.

After extensive presentation, and paying an exorbitant amount for attorney fees, I was able to regain a more comfortable schedule with Noah doing a Standard Possession Order in place. This stability lasted about 10 months before the next unhappiness arrived with Noah's mother. Around June, she began to get unhappy that I would have my first full month of summer visitation with Noah. After picking up Noah for the summer, around the 19th, she requested to have weekend visitation. I notified her that this request was outside of the deadline, April 15th, in which she was supposed to notify me of her chosen weekend in July to have him. I had already made plans with family that weekend I could not cancel. This sent her OFF THE RAILS.

Every day from this moment on was a complete hell hole. She began calling SAPD to my home for welfare checks for one week straight. At times, calling morning, afternoon, and night on the same day. Then, she began calling the Sheriff's Office to perform welfare checks at my girlfriend's house. We are still unsure how she managed to even get her address! Not once did I avoid any officer's visits. We clearly explained the situation to them and asked them to document this erratic behavior on their end. Once SAPD and BCSO began to see the pattern, they notified Noah's mother that they will escalate all future calls to a supervisor, in which they will determine the severity of the request. When this tactic was no longer working, this is when she began utilizing CPS as a weapon on her behalf. Both my girlfriend and I received upwards of 4 inquiries within a month's span with CPS ranging from assault and abuse allegations to spousal domestic abuse in the home. All were addressed and disproven to the agents (even the allegation that she found bruising on him 2 days before he was returned home from summer visitation!).

On the week after I last saw my son, August 16th-18th, Noah's mother has once again withheld him from me. She filed one last CPS accusation that he returned back home to her with bruising on his right cheekbone. An agent contacted me claiming that aside from the previous contacts that were made, the agency was actually receiving many more accusations from her that they did not deem necessary to make contact for. A supervisor noticed this pattern and this caused a complete open investigation from the agency. He addressed the previous calls and accusations, and we provided full proof that this was not happening during our care. Because we knew of the false allegations happening already, we were documenting full body pictures and videos of Noah at the time of pickup and his condition when he was returned home. This documentation instantly disproved the allegations for the agent, but it did open up more concerns on our behalf. We were notified of recent medical conditions that Noah's mother did not disclose to us.

When the investigator did a home visit on August 22nd, he noticed a very large swollen ball on Noah's forehead. This was disclosed to us and it began the questioning of whether Noah was purposely being abused to justify the purpose of the false allegations being made to CPS.

It has been going on 2 months now since I have last seen my son, and I am asking for any support you may provide to help with relieving any financial strain and stress this has caused us. We are in the process of another Motion of Enforcement and Modifying Final Orders. This will of course be at a cost in continuing to retain our current attorney who is supporting us in this matter. The holidays are coming up, Noah's birthday which I will most likely miss, and the new year. This is the toughest time to gather any money for this matter, so I am asking at the mercy of my family, friends, or anyone in this community to please donate anything you feel is justifiable in helping me in this cause.

Noah is the sweetest, smartest, and exact replica of me. He is my new best friend and future partner in crime vs. the world. I do not want him to continue a life without his father in it. I am not a deadbeat father! I believe I am a good man, a good father, and a good provider. I pay my child support on time and am not in arrears or have missed any payments. I am constantly fighting to have my son with me. I just want my son back and I want him in a safe environment. There is plenty more I wish to say here, but I am bound by the legalities of what I can say and what has been proven. These attorney fees and court fees are no joke, and for some reason, I am not able to receive free representation from the non-profit organizations. I am putting my pride aside and asking for the support of my community to help me move forward with a better life for my son and me.
