We are pushing for EU institutions to regulate AI training and protect our data.

Summer 2022 has seen the rise of a new, incredible technology: AI text-to-image (TTI) or image-to-image. These forms of artificial intelligence can generate images from textual prompts or other images given by the user. To do so, an AI needs to be trained on a dataset of images.

The quality of a generative AI is defined by the quality of its dataset--the more pictures and illustrations it learns on, the more styles the AI is able to replicate and the more things it can do. Therefore, the products sold by AI companies are the result of operations on datasets, which contain all sorts of data, including copyrighted images, private pictures and other sensitive material indiscriminately scraped by bots from every corner of the web. AIs are able to generate the results we can see on a daily basis on our social media because they use our data and take from artists’ original works. Our data and works are being exploited. The way these companies are training their AIs do not meet the minimum requirements imposed by basic human rights that are foundational to our society.

Our creativity and our professionalism cannot be used to create images or products with the sole purpose of profit-generation by a handful of companies who select to exploit and abuse the human work of artists in the world.

All the creative professions, not only the visual ones, should fight to defend their work and identifying heritage.

By funding this campaign, you will help us in supporting the legal fees necessary to enforce a EU-level regulation of the practices these companies use to gather data.

These are the key points we want to enforce:

1) Any data related to people or works, in any form, be it digital data – such as text files, audios, videos or images – or captured from reality by camera, microphones or any other mean of registration, shall not be used to train AI model without the explicit and informed consent of its owner. We ask for an extension to the AIs of the principles protecting personal data previously introduced by the GDPR and the introduction of a new form of protection specifically for this kind of exploitation: the “training right”.

2) Using the names of people, stage names or titles of works not covered by a license to exploit for AI training shall be prohibited for those software that allows the use of textual or vocal prompt to generate images, videos, texts or audio.

3) Using videos, images, audios and texts not covered by a license to exploit for AI training shall be prohibited for those software that allow to upload media contents to generate an image, a video, a text or an audio.

4) A “human and machine readable” indexing and certification system shall be established, reporting all AIs’ activities and the full content of their datasets of images, texts, videos and sounds, be them fully or partially reproduced. Captions such as “entirely made by AI”, “made using AI-generated material” should become the standard to ensure the proper functioning of AIs themselves.

5) The distinction between “copyrighted material” and “public domain" is no longer adequate to identify what can and cannot be used for the datasets. Learning datasets contain personal sensitive data, protected by the privacy laws, but not by copyright. We can find examples of material released when it would not have been possible to foresee its use in a dataset to train an AI model. Any data used in training model shall be curated and authorized by its legitimate owner and willingly inserted in the dataset by its author with full knowledge of it. AI companies shall produce internally original materials for the training or license external material following terms and contracts previously established with the authors of said material.


Q: Who are you and why should I trust you?
A: MeFu – Mestieri del Fumetto was constitued may 1st 2020 as a research group with the objective of investigate and study the financial situation of Italian comicbook authors, including writers, artists, pencillers, inkers, colorists and letterers.
On February 24th 2021, MeFu became a legally registered non-profit association, operating for the acknowledgement, the promotion and the protection of those categories, and working to represent and help them in their relationship with their counterparts (publishers, conventions), with public institutions and with other entities or people. Furthermore, MeFu conducts activities to spread useful information for the community of comicbook authors and to sign pacts and agreements to benefit its associates and the whole category.
MeFu’s executive board is composed of Francesco Archidiacono, Samuel Daveti, Claudia Palescandolo and Emanuele Rosso.

A group of accomplished comicbook professionals was also involved in founding MeFu, in order to better represent the diversity and complexity of the Italian comicbook market. This group is composed of:

Q: What do you need this money for?
A: by funding this campaign, you’ll help us bear the legal fees necessary to enforce a EU-level regulation of how data are collected for AI training. We expect the work to go on for at least 2 years, with a monthly expense of 3.000€.
The expenses you are financing are the following:
- Working with the institutions to change the AI ACT. This is by far the most expensive objective, as it involves of specialists in copyright law and data processing and an extensive communication effort with the European institutions in Bruxelles.
- Communication activities gathered towards all the professionals in the creative field. In order to maintain the campaign’s momentum, we will need an ongoing communication strategy towards investors and members of the global creative community.
- Media relations activities.
- Social media strategies and content creation to raise awareness in the institutions and in the Government.

Q: 70.000€ is a lot of money! How are you going to spend them?
A: It does seem like a lot, but it’s a number that must be contextualized: as Mefu, we have a clear idea on what we want to achieve with this battle, but we dont’have the internal resources nor the expertise to face the operative and technical steps involving writing regulatory proposals, which require the work of experts in the field of copyright law, privacy law and international legislation. Let alone the competence and knowledge necessary to face a technical panel at the European Community alone. This is why we need 35.000€ per year: to have available on our side some among the best experts around, professionals with a career of success in these fields in Europe for 2 years of high-intensity work. It is a little more than 3.000€ per month to have the possible maximum impact on the European regulation. You can see that 70.000€ it’s the minimum requirement and if you have started to think that it seems too little, you should know that these experts care for this cause and that’s why they offered us a highly discounted price!
If we manage to surpass our initial goal, we will use the additional funds to organize events involving artists, companies and institutions from all over the world, to help raise awareness on the theme.

Q: Ok, but who are these experts you keep mentioning?
A: We have asked the help of VERA Studio, a company founded by Francesco Schlitzer. Francesco and his colleagues have a unique and invaluable experience in the copyright and intellectual property rights fields. In 2012 thanks to VERA Italy became the first EU country to liberalize video and music artists' proprietary rights, which used to be badly managed and not distributed to those artists by an inefficient monopoly, which got liquidated at a later time. In 2021 VERA successfully fought to change the text of the European directive on copyright to protect the economic rights of those artists whose work is exploited by streaming platforms. Another reason behind our choice is that VERA Studio doesn't have among its clients companies involved in the art, movie or entertainment fields, working exclusively in defense of artists' and creatives' rights. During the last three months, VERA has offered us its counseling in setting up the early stages of our campaign and the activities with the European institutions for free.

Q: Does Mefu keep anything from the money I’m donating?
A: Absolutely not. MeFu and all its members work only for political activism, spending their own time, money and professionalism exclusively for the cause, just like you who are funding it.

Q: Are you really going to be able to carry on such a difficult and harsh battle using only these funds?
A: No. We want to involve all those companies that work in the creative field, such as publishing and production houses, animation studios, fashion houses, design labels, creative studios and those companies that manufacture all the materials needed for creativity, be them traditional art or digital art material. We hope that each and every one of these entities will also help us on the operative side, offering logistical, strategical and economical support.

Q: I have no idea of what you are talking about. Should I really be worried? Can you give me some more information?
A: Sure!


Q: So, are you luddites? Are you against progress?
A: Absolutely, categorically no. Here’s an example: in the printing field technology has made incredible steps forward, yet there are things that can’t be printed freely (such as money, otherwise we wouldn’t have needed this campaign!) or that can’t be mechanically reproduced for profit without publishing and editorial rights (movies, books, comics, etc.). This happens not because of limits in the technology, but because of ethical and normative rules. Likewise, we don’t want to limit the technology and we hope it can reach even more amazing and incredible feats. We just believe that technology has to be used with more respect for the community, and not just to speed up the run towards a technological monopoly and a market ruled by few private entities. We hope for a world in which using AIs for visual projects can be done without having to ethically compromise ourselves.

Q: I'm not a EU citizen, but I want to help. Any suggestion?
A: We will accept any kind of help and donation, but check out the Concept Art Association's gofundme as well. They are working to enforce AI companies regulations in the US:

Stiamo assistendo al più grande furto di dati e proprietà intellettuali di sempre.
Se pensi che i tuoi dati e le tue opere d’ingegno non debbano essere sfruttate impunemente a scopo di lucro da una manciata di aziende private, questa è la battaglia che devi sostenere.

L'estate 2022 ha visto la diffusione di una nuova, incredibile tecnologia, le AI text to image (TTI) e image to image, intelligenze artificiali che generano immagini a partire da testo o da altre immagini.

La qualità di un'AI generativa dipende dalla qualità del suo dataset di immagini: più immagini ci sono, più stili l'AI può replicare e più cose può fare. Quello che le società di AI vendono è, insomma, il risultato di operazioni su dati. I dati presenti in questi dataset sono di ogni tipo e includono immagini coperte da copyright, foto private e altri dati sensibili, raccolti indiscriminatamente dai bot. È solo grazie al lavoro degli artisti e ai dati di tutti noi che costituiscono i dataset che le AI sono in grado di produrre i risultati che vediamo condivisi tutti i giorni sui social. In tutti i casi si tratta quindi di dati che sono completamente fuori dai requisiti minimi imposti dal rispetto dei diritti umani che regolano la nostra comunità.

La nostra creatività e professionalità non può essere utilizzata per creare immagini o prodotti che hanno il solo scopo di arricchire una manciata di società con una simile politica predatoria che si stanno arricchendo attraverso lo sfruttamento e l’abuso del lavoro di tutti gli artisti del mondo.

Tutte le professioni creative, non solo quelle visuali, dovrebbero difendere il proprio patrimonio identitario.

Donando a questa campagna ci aiuterai a sostenere le spese legali necessarie a far regolamentare a livello comunitario il modo in cui queste società raccolgono i loro dati.

Questi i punti che vogliamo far rispettare:

1) Tutti i dati relativi a persone o opere, in qualsivoglia forma, siano essi già
digitalizzati come file di testo, audio, video o di immagine o catturati dalla realtà
attraverso videocamere, microfoni o qualsiasi mezzo di registrazione, non devono poter essere utilizzati per il training di modelli di AI senza l’esplicito consenso
informato dei loro legittimi proprietari. Chiediamo quindi l'estensione dei principi di salvaguardia dei dati personali già introdotti al web dal GDPR anche alle AI e l'introduzione di una nuova forma di tutela per questa nuova forma di sfruttamento: il "training right".

2) L’utilizzo di nomi di persone, nomi d’arte o opere che non sia coperto da una
licenza di sfruttamento per il training di AI deve essere proibito dai software che
consentono di inserire un “prompt” testuale o vocale per richiedere la generazione
di un'immagine, di video, testo o suono.

3) L’utilizzo di video, immagini, suoni e testi che non sia coperto da una licenza di
sfruttamento per il training di AI deve essere proibito dai software che consentono di inserire media per richiedere la generazione di un’immagine, di video, testo o suono.

4) Deve essere istituito un sistema di indicizzazione e certificazione standardizzato, “human e machine readable” delle attività delle AI e dei dataset di immagini, testi o suoni interamente o parzialmente prodotte con AI. Diciture come “interamente generato con AI”, “realizzato utilizzando materiale generato con AI” dovrebbero diventare lo standard anche per garantire un corretto funzionamento delle AI stesse.

5) Non appare sufficiente il discrimine tra materiale “copyrighted” e “di pubblico
dominio” per individuare cosa può e cosa non può finire dentro i data set. Nei data set possono infatti trovarsi anche dati personali sensibili, quindi protetti dalle leggi sulla privacy, ma non da copyright. Al tempo stesso, esistono casi di materiale pubblicato in un momento in cui non si poteva prevederne l’utilizzo nel contesto di dataset per il training dei modelli di Intelligenza Artificiale. Ogni singolo dato che viene inserito nei modelli di training deve essere curato e autorizzato dai legittimi proprietari e quindi inserito in maniera volontaria e informata dai singoli autori. Le aziende di AI devono produrre internamente materiali originali per il training o licenziare contenuti esterni secondo termini e condizioni contrattuali precedentemente stabilite con gli autori interessati.

Q: Chi siete? Perchè dovrei fidarmi di voi?
A: MeFu – Mestieri del Fumetto nasce il 1° maggio 2020 come gruppo di ricerca che si pone l’obiettivo di indagare quale sia la situazione economica di chi crea fumetti in Italia.

All’interno di questa categoria rientrano: autor* unic*, soggettist*, sceneggiator*, disegnator*, inchiostrator*, colorist* e letterist* (ed eventuali altri ambiti specifici, ma sempre propri del linguaggio del fumetto, che dovessero definirsi).

Dal 24 febbraio 2021 MeFu – Mestieri del Fumetto è riconosciuta legalmente a tutti gli effetti come associazione senza scopo di lucro, con il fine di operare per il riconoscimento, la valorizzazione e la tutela dell’attività professionale delle categorie indicate in precedenza, e di rappresentarle unitariamente e assisterle nei rapporti con le naturali controparti, nelle pubbliche relazioni interne e internazionali, nei rapporti con i pubblici poteri, e nelle relazioni con altri enti o persone.

L’attività di MeFu si rivolge sia a chi si associa, con l’obiettivo di garantire i suoi interessi economici, giuridici, fiscali e sindacali, e di stipulare accordi e convenzioni a suo beneficio, sia a tutta la categoria in generale, attuando iniziative di sostegno e diffondendo informazioni e aggiornamenti che possano essere utili e giovare alla comunità del fumetto.

Il consiglio direttivo di MeFu è formato da Francesco Archidiacono, Samuel Daveti, Claudia Palescandolo ed Emanuele Rosso.

Inoltre è stato coinvolto un gruppo di affermate figure professionali che potesse rappresentare al meglio il fumetto italiano nella sua diversità e complessità, in termini di ruoli, di mercati e di percorsi artistici. Questo gruppo è composto da:

Q: A cosa servono questi soldi?
A: Donando a questa campagna ci aiuterai a sostenere le spese legali necessarie a far regolamentare a livello comunitario europeo il modo in cui queste società raccolgono i loro dati.
Prevediamo che ci vorranno almeno 2 anni per raggiungere il nostro obiettivo, con una spesa mensile di circa 3.000€.
Le attività che stai finanziando sono:
- Attività di relazioni con le istituzioni per la modifica dell’AI ACT: questa attività è senza dubbio la più onerosa perchè prevede legali specialisti nel diritto d'autore e nel trattamento dei dati così come un intenso lavoro di comunicazione con le istituzioni a Bruxelles.
- Attività di comunicazione verso i soci e i professionisti del settore della creatività:
Per tenere viva la campagna avremo bisogno di un continuo lavoro di comunicazione verso l'esterno, ma anche verso gli investitori e i membri della comunità creativa.
- Attività di media relations
- Creatività e PED sui social media per sensibilizzare le istituzioni e il Governo

Q: 70.000 euro sono un sacco di soldi! Come avete intenzione di spenderli?
A: Sembrano molti, ma vanno contestualizzati: MeFu ha le idee chiare sui punti fermi della battaglia, ma non ha le risorse interne ne le competenze per affrontare la fase operativa e tecnica di scrittura delle proposte normative che richiedono esperti di diritto d'autore e di privacy, come di legislazione internazionale. Tantomeno la capacità di affrontare da sola un tavolo tecnico alla Comunità Europea. Per questo è necessaria la spesa di circa 35.000 euro annui per avere a disposizione alcuni fra i migliori esperti in circolazione, professionisti con uno storico di successi europei in questi ambiti, e garantire loro la possibilità di due anni di attività intensissima. Si tratta quindi di poco meno di 3000 euro al mese per avere il massimo dell'impatto possibile sul regolamento comunitario europeo. Capisci da solo che si tratta del minimo indispensabile e se ora ti sembrano troppo pochi è bene che tu sappia che anche questi esperti hanno a cuore la battaglia in cui li stiamo coinvolgendo e proprio per questo hanno offerto una tariffa scontatissima!
Se riusciremo a superare la soglia minima di 70.000€, i fondi aggiuntivi verranno investiti nell'organizzazione di eventi che coinvolgano artisti, aziende e istituzioni da tutto il mondo per sensibilizzare al tema.

Q: Ok, ma chi sono questi esperti a cui vi state affidando?
A: Abbiamo scelto VERA Studio la società fondata da Francesco Schlitzer. Francesco e i suoi colleghi hanno un’esperienza unica nel settore del copyright e dei diritti di proprietà intellettuale. Nel 2012 ha ottenuto che l’Italia fosse il primo paese in Europa a liberalizzare i diritti patrimoniali degli artisti musicali e del video, che venivano mal gestiti e non distribuiti agli artisti da un monopolio inefficiente, poi messo in liquidazione. Lo scorso 2021, durante il recepimento della direttiva europea Copyright, VERA si è battuta con successo affinché il testo della direttiva fosse migliorato a tutela dei diritti economici degli artisti il cui lavoro viene sfruttato dalle piattaforme streaming. Un altro motivo della scelta è che VERA Studio non ha nel portafoglio aziende attive nel settore delle arti, del cinema o dell’entertainment, ma lavora esclusivamente in difesa dei diritti degli artisti e dei professionisti che operano nel settore; questo ci assicura l’assenza di qualsiasi conflitto di interessi. Negli scorsi tre mesi, VERA ci ha fornito gratuitamente la propria consulenza per impostare le prime fasi della nostra campagna e avviare l’attività con le istituzioni europee.

Q: Di questi soldi che doniamo Mefu trattiene o guadagna qualcosa come associazione?
A: Assolutamente no: MeFu e tutti i suoi membri sono a disposizione per puro attivismo politico, spendendo cioè tempo e denaro e investendo al propria professionalità per il bene esclusivo della causa, esattamente come te che effettui la donazione.

Q: Davvero riuscirete a portare avanti questa battaglia così complessa con il solo aiuto di questi fondi?
A: No. Vogliamo coinvolgere anche le aziende che si occupano di creatività a 360 gradi, come case editrici, di produzione, studi di animazione, case di moda, firme del design, studi creativi, aziende che producono materiali per la creatività siano essi articoli di belle arti tradizionali o di disegno digitale. Speriamo che ognuna di queste realtà contribuirà anche sul piano del supporto operativo offrendo supporto su più livelli, sia esso economico, strategico o logistico.

Q: Ok. Non ho minimamente idea di cosa state parlando. Davvero devo essere preoccupato? Potreste darmi qualche ragguaglio?
A: Certo, buona lettura!


Q: Quindi siete dei luddisti? Siete contro il progresso?
A: Assolutamente no. Ti portiamo un esempio: nella stampa la tecnologia è progredita raggiungendo livelli insperati eppure ci sono alcune cose che non è possibile stampare liberamente (i soldi ad esempio, altrimenti non ci sarebbe servita questa campagna) o che non è possibile riprodurre meccanicamente per scopo di lucro se non si hanno dei diritti di edizione (come per film, romanzi, fumetti etc). Questo accade per una convenzione etica e normativa, non per una limitazione tecnologica. Noi non vogliamo limitare la tecnologia e anzi speriamo che arrivi a svilupparsi verso risultati sempre più incredibili. Crediamo solo che vada usata con un maggiore rispetto della comunità e non solo per accelerare la corsa al monopolio tecnologico e di mercato di pochissimi soggetti privati. Speriamo in un mondo in cui usare le AI per progetti visuali possa essere fatto senza dover scendere ad un simile compromesso etico.
