Help Preserve the Character of Dyes Inlet

Who we are: Dyes Inlet Preservation Council (“DIPC”) was formed by local residents in 1990 to preserve and protect the environmental quality and rural character of Dyes Inlet and in a particular preserving what is left of an Open Space Core bordered on the North by Bucklin Hill Road, on the West by Dyes Inlet, and on the east by Tracyton Boulevard.

The issue: Dyes Inlet and its adjacent lagoon/estuary are threatened by a proposed apartment complex consisting of four apartment buildings hundreds of feet from the shoreline.  Each 40 unit building will be FOUR stories tall for a total of 160 units making it one of the biggest apartments in the Silverdale area. The site is on wetlands and a critical aquifer recharge area and part of the Bucklin Hill view corridor.

The Proposed Project: Silverview LLC (“Developer”) applied to Kitsap County (the “County”) for an Administrative Conditional Use Permit to build the Silver View Apartments (the “Project”) on a 5.34 acre property at 9506 Mickelberry Road in Silverdale (south of Maynard’s Restaurant and the Social Security Building on Bucklin Hill Road). This site now consists of an abandoned house and barn on unmaintained farmland. The Developer plans to construct 4 multifamily buildings with 160 residential units (40 units per building), a clubhouse, and parking garage. The apartment buildings are FOUR stories total: 3 stories above grade with daylight basement units below grade. Over 75% of the site will be impervious surfaces, meaning polluted rain water will run off this site toward Dyes Inlet.  We are told as much as 5.5 MILLION gallons of water could flow into Dyes Inlet per year.  Dyes Inlet is a part of the Kitsap Peninsula National WaterTrails and in 2014 was designated by the US Department of Interior part of the National Water Trails System, the first in WA State and the only natural, saltwater trail in the USA.

Why This Project is a Problem for Dyes Inlet: The proposed Project will be located on wetlands and a critical aquifer recharge area. The location is surrounded by large rural lots with single-family homes and small businesses. It is 350 feet from a lagoon/estuary connected to Dyes Inlet and roughly 600 feet from the Dyes Inlet shoreline. Our experts have said that the apartment footing excavation could puncture underground aquifers and threaten wells. It could devastate the nearby lagoon/estuary.  Additionally, we have not seen evidence that the proposed sanitary sewer system is even viable.  The environmental impact on wetlands, storm water runoff, the aquifer, groundwater, drinking water, water rights, water quality, habitat, Dyes Inlet, and a lagoon/estuary could be irreparable.

The project places the maximum density on the edge of zoning district with no regard for the character of the area and no transition to adjacent use. This massive boxy, flat-roof residential development is  out of scope and character with the neighborhood & blocks views the community enjoys at Maynard’s Restaurant. It would add light & noise, increase density, add traffic, create parking issues, and forever change the aesthetics, and character of the area. 

What action is being taken: Bricklin & Newman, LLP (“Bricklin”) agreed to represent the neighbors and DIPC in opposing the proposed Project.  Bricklin filed a MDNS appeal on May 12, 2020. On August 17, 2020, they filed an appeal of the Approval of the ACUP and on September 8 they filed an appeal of an updated ACUP approval.  Our hearing date is November 12 and 13.  To support our appeal, together with the other appellants we  hired experts in stormwater, hydrology, ecology, traffic, and design. This all costs money.
