I am also Founder and Chairman of Freedmen's Intl Charitable Foundation a not for profit 501 c (3) {Pro Se Litigant Assistance Enterprise} established to promote a sustainable sanitized version of capitalism by exercising "certain unalienable Rights" anointed by the creator to ensure Life, Liberty and the Pursuit of Happiness" while defending the sacred values of the United States Constitutions (14th) Fourteenth Amendment "Equal Protection Clause" provisions.
The 21st century evidence is clear that the United States Constitution (14th) Fourteenth Amendment "Equal Protection Clause" provision is being subverted by private interest for profit in a political economic exploitation conspiracy for those municipal and state government operatives that continue to practice systemic Colonialism's "WICKED" innately corrupt "White Supremacist Wealth Creation" business model.
The Colonial business model {SOP} is in fact driven by unbridled greed and based on a "Fictious White Supremacist- Social Construct" commonly known as "RACISM" wherein Life, Liberty and Justice for all cannot and does not exist!
In my view for the record the {Patriot 21st century American Capitalist} must purge the mentality of the Colonial DNA embedded in the mindset of our municipal Governance to ensure the financial and economic wellbeing of all of our American citizens, if the citizens of the whole world are to prosper.
Now herein please be advised of the following. The state of Kansas Secretary of the Dept of Commerce, David Toland established the Strengthening People and Revitalizing Kansas {SPARK} a quasi-government organization executive committee. The SPARK EXECUTIVE COMMITTEE is in fact also, Chaired by Lieutenant Governor David Toland.
The SPARK executive committee is responsible for systematically making an unconscionable decision to invest less than 1% of $1.6, billion American Rescue Plan Act allocation (ARPA) into the State of Kansas African American owned businesses and communities of color. There are approximately 8588 African American owned businesses in the state of Kansas.
"The Strengthening People and Revitalizing Kansas {SPARK} Economic Revitalization Panel received 400 proposals totaling $7.9 billion including but not limited to the Freedmen's Public Welfare Investment proposal a capital formation strategy that shall in fact leverage $150 million using the existing authority in US Financial System to create not less than $7.5 billion in business capital and credit." - $2.5 billion in private capital to fund startups and MBE
- provide up to $5 billion in bank deposits for
- Seed and Venture Capital-SBA loans, USDA loan and
- Community Development loans
- Affordable housing development loans
- other forms of commercial lending
With that being said, on December 21, 2022, the-State of Kansas Finance Council approved a total of $374 million of the $1.6 bn in ARPACOVID19 relief funds for broadband infrastructure and adoption, the modernization and improvement of government services, economic development, and health and education initiatives recommended by the Kansas SPARK Executive Committee. Approximately $157 million of the $347 million was allocated to the SPARK economic revitalization panel.
Now herein the bottom line is that the State of Kansas SPARK Executive Committee Chaired by David Toland, Secretary of Kansas Dept of Commerce "neglected its duty owed" to the citizens of State of Kansas by failing to address the $7.9 billion needed to produce the intended outcome of American Rescue Plan Act for the citizens of Kansas in particularly the communities of color.
- I trust we can agree, if I was a Whiteman citizen and or immigrant Whiteman presenting the Freedmen's PWI opportunity Kansas House Representative, Sean Tarwater Chair of the SPARKS Economic Revitalization Panel would have recommended my proposal to be approved.
In my conclusion, my "42 USC 1983 Civil Rights Complaint" challenges the unconstitutionality of the “Defendant” Secretary of the Department of Commerce, State of Kansas (ILLEGAL-UNEQUAL RACE BASED) distribution of Coronavirus State Fiscal Recovery Fund (SFRF) consisting of approximately (One Billion six hundred and sixty-nine million dollars) in (the American Rescue Plan Act of 2021) (ARPA) funds by the SPARK executive committee now managing the $1.6 billion American Rescue Plan Act fund.
