
Help me get Ami back
As you all know, I've been having a difficult time in Asheville North Carolina and though I'm far from friends and family, many locals have come out to show their support, encouragement and help.
At this point, I'm dealing with three intersecting matters of law- criminal law, civil law and immigration law.
I spent two weeks at the Buncombe County Detention Facility for allegedly assaulting a government official, resisting arrest, and disorderly conduct. I have a public defender for this case.
The reason I spent two weeks in jail was that the local bondsmen don't have insurance to bail out immigrants, in case I run out of the country. They insisted on being paid the whole bond amount of $6,000. Luckily a friend came out to help.
When I got out of jail, I went to the Buncombe County Justice Resource Center to enroll for the adult misdemeanor diversion program to get help with clearing my charges.
Within a minute of hearing my story, the intake officer said he felt that my life was in danger and took me to the Family Justice Center. They told me I was a victim of domestic violence and should consider filing for emergency child custody for my daughter. I felt we should start with a mediation but they insisted that my husband might become violent.
While I've found my husband and his family to be emotionally abusive, I don't consider them violent and/or dangerous. In the end, I got a letter from the Asheville Police Department letting me know they were concerned for my welfare.
In the past week, my husband has gone to court and taken out emergency child custody against me. He and his family have kept my daughter away from me. They have also taken my daughter out of school.
I've been running around collecting evidence against his allegations and it's been expensive. I get help from local legal services but they're overwhelmed and can't help much with my case.
