HELP JENS ZIJN ZOON TE ZIEN OPGROEIEN.

Mijn broer is een liefdevolle en toegewijde vader van 42 jaar. Al jaren probeert hij op een eerlijke manier contact te houden met zijn zoontje, maar hij raakt steeds verder verwikkeld in een slopende juridische strijd.

Hoe het begon

Een aantal jaar geleden kreeg hij samen met zijn toenmalige partner een kindje, in 2019. Toen hun zoontje nog maar twee jaar oud was, besloot de moeder plots te vertrekken. Sindsdien is het contact tussen vader en zoon steeds verder verwaterd. Mijn broer verliet het huis, zij bleef er wonen. In het begin was er nog wat telefonisch contact, maar dat werd steeds minder.

Een strijd die maar doorgaat

De omgangsregeling die in de loop der tijd werd vastgelegd, werd keer op keer door de moeder belemmerd. Ze stelde telkens nieuwe voorwaarden en deed aanklacht na aanklacht – vaak zonder inhoudelijke grond, met als gevolg dat het proces maar bleef voortduren en Jens financieel uitgeput raakte.

In de twee eerdere rechtszaken heeft de rechter al in Jens zijn voordeel geoordeeld. Steeds opnieuw moest hij via de rechter vechten voor contact, en steeds opnieuw kreeg hij gelijk. Maar door het telkens opnieuw aanvechten van de beslissingen door de moeder wordt het proces eindeloos gerekt, waardoor Jens zijn zoon al meer dan twee jaar nauwelijks meer ziet. En hoe langer dit duurt, hoe moeilijker het wordt om hun band te behouden.

Ook al weet de moeder dat Jens dit juridisch getouwtrek financieel en mentaal nauwelijks nog kan dragen, lijkt de strijdbijl nog niet begraven, met alle gevolgen van dien.

Financieel

De juridische kosten stapelen zich al jaren op. Jens heeft inmiddels duizenden euro’s moeten betalen om zijn recht te halen — geld dat hij grotendeels heeft moeten lenen, steeds denkend dat het de laatste ronde zou zijn.

• Voor de bodemprocedure in 2023 betaalde hij in totaal €976, bestaande uit advocaatkosten en griffierecht.

• In 2025 volgde een kort geding, waarbij hij tot nu toe al €1.976,85 heeft betaald. De eindfactuur van €1.428,01 staat nog open. Daarnaast wordt er nog een extra kostenpost van €145,45 verwacht voor de betekening van het vonnis.

En nu komt het hoger beroep eraan, gepland op 1 juli 2025. Hiervoor is opnieuw ongeveer €5.000 nodig. Een bedrag dat Jens simpelweg niet meer kan opbrengen, maar dat wél het verschil maakt tussen opgeven of doorgaan.

Waarom deze actie?

We hebben als familie ontzettend lang nagedacht hoe we Jens kunnen ondersteunen en besloten tot deze actie.

Want het is niet alleen Jens die zijn zoon mist.

Ook zijn moeder — de oma van Jens haar jongste kleinkind — mist haar kleinzoon vreselijk. Zijn broers, zussen, nichtjes, neefjes: allemaal hopen ze dat de kleine jongen zijn vader weer kan zien. Dat hij zich weer verbonden kan voelen met zijn familie, met zijn roots. We hopen dat er snel een einde aan de rechtszaken zal komen, voor Jens maar vooral voor zijn zoon, die zich inmiddels steeds bewuster begint te worden van deze onnodige strijd.

Help Jens Fight for His Son – A Father Who Refuses to Give Up

My brother is a loving and devoted father, 42 years old. For years, he has been trying to maintain contact with his young son in an honest and respectful way. But he’s now caught in an exhausting legal battle that seems to have no end.

How it started

A few years ago, he and his then-partner had a child together, born in 2019. When their little boy was only two years old, the mother suddenly decided to leave. Since then, the contact between father and son has slowly faded. My brother moved out of the house, while she stayed. At first, there was still some phone contact, but that gradually disappeared.

A battle that never ends

Over time, a visitation arrangement was put in place, but the mother continually blocked or complicated it. She kept setting new conditions and filed complaint after complaint—often without solid grounds—causing the legal process to drag on endlessly, draining Jens both financially and emotionally.

In two previous court cases, the judge ruled in Jens’ favour. Time and again, he has had to fight in court for the right to see his son, and each time, the court agreed with him. But because the mother keeps challenging every decision, the process is endlessly prolonged, and Jens has barely seen his son for over two years now. And the longer this goes on, the harder it becomes to preserve their bond.

Even though the mother knows Jens can hardly bear this legal struggle—both financially and mentally—the battle seems far from over, with all the painful consequences that brings.

Financially exhausted

The legal costs have been piling up for years. Jens has already had to pay thousands of euros to fight for his rights—money he has largely had to borrow, each time believing it would finally be the last round.

• For the main court case in 2023, he paid a total of €976, including solicitor’s and court fees.

• In 2025, an urgent court procedure followed, for which he has already paid €1,976.85. The final invoice of €1,428.01 is still outstanding, and an additional fee of €145.45 is expected for the official serving of the verdict.

And now, the appeal is coming up, scheduled for 1 July 2025. This will again cost around €5,000—an amount Jens simply cannot afford any longer. But it’s the difference between giving up or continuing to fight for his son.

Why this campaign?

As a family, we’ve spent a long time thinking about how we can support Jens, and we’ve decided to start this campaign.

Because it’s not just Jens who misses his son.

His mother—the grandmother of Jens’ youngest child—misses her grandson terribly. His brothers, sisters, nieces, nephews: we all hope that this little boy will see his father again. That he can feel connected to his family, to his roots.

We hope this endless legal battle will soon come to an end—not only for Jens, but especially for his son, who is now becoming more and more aware of this unnecessary struggle.
