Help Support my Tribunal Case Against Epsom & Ewell Council

Despite many objections from local residents and Glyn School, the Epsom and Ewell Borough Council have approved their own planning application (23/00158/FUL) for the council to build 3 modular homes to move homeless out of temporary hotel accommodation onto a private unadopted road. The Epsom and Ewell Borough Council did not have access in their title deeds to the development site over the private unadopted road, Fairview Road. However, they pressed on and have attempted to claim a right of way over Fairview Road by submitting a statutory declaration to HM Land Registry. Local residents of Fairview Road have disputed this access, as they believe the statutory declaration to be factually incorrect and omits significant details that could disqualify The Epsom and Ewell Borough Councils claim for access.

For over two and a half years now, I have been fighting to ensure that the Epsom and Ewell Borough Council adhere to the access as per their title deeds. It has now reached the point where the Epsom and Ewell Borough Council have taken the matter to the HM Land Registry Tribunal. Residents feel strongly about this issue, as Fairview Road in Epsom is an unadopted road maintained at residents own expense. Objections were raised on safety concerns as Fairview Road is a very narrow, unlit unadopted road used by Glyn School pupils to walk to school and local residents to walk to Sainsburys Kiln Lane store. As part of the planning application The Epsom and Ewell Borough Council refused to make any maintenance contributions or safety improvements to the road, despite increasing the number of dwellings in the road by 50%. Thereby, causing a potentially very serious safety issue for pedestrians and school children who use the road and placing the burden of maintenance costs solely on the existing residents.

All funds raised will be used to fund any legal costs, expert witnesses and other incidental costs related to the HM Land Registry Tribunal and the GoFundMe page will be updated with receipts showing how all funds have been spent. Any remaining funds shall be donated to the following charities:
