Help Eva Sands Win Her Legal Battle

Our mother, Eva, is an Alzheimers patient who is being sued by the assisted living facility where she was residing in 2020. We are asking for your support in helping Mom fight this terribly unfair lawsuit.

We moved Mom into the memory care unit of an assisted living facility called Village Walk in Patchogue, NY at the end of July 2020. A couple of months later, in September and October of 2020, Mom was sent to a nearby rehab facility to help her deal with some changes in her condition. At the beginning of November, as we were coordinating with the Director of Healthcare at Village Walk, he informed us that Mom could not return there, because of the "aspiration precaution" that the rehab facility had placed into her medical record.

As we scrambled to find Mom a new place to live, we made calls and sent many emails to Village Walk, attempting to figure out all the arrangements for moving Mom to a new facility, including calls and emails to the Executive Director herself. All of the attempts at communication with the Executive Director went unanswered. There were some emails with the Facilities Manager that were answered, but only to say that he would pass the message along to the Executive Director.

So Mom had to continue to stay at the rehab facility through November and December of 2020, and we were able to move her into a wonderful new enhanced assisted living facility on December 30. Mom hadn't been at Village Walk since mid-September.

However, Village Walk has now filed a lawsuit claiming that Mom owes them $19,825.48 for three months of rent and care for November, December and January. Mom hadn't been living there during that timeframe, because Village Walk had decided back in early November that Mom could not return to their facility.

Mom barely has enough income to pay for her care at the new assisted living place, so as you can imagine, having to pay legal fees to defend herself is way beyond her means. The retainer alone for an attorney is $3000, and she will have to spend much more than that in order to win this case without paying some settlement to Village Walk.
