”I’m a loving mother of twin boys with Autism Level 3, Intellectual Impairment, ADHD, Sensory Processing Disorder, and Global Developmental Delay. I’ve been raising these children solo for 4 years and all of a sudden, the other parent has been awarded full custody, and a change of residence for the children has been granted to him, which is more than 400kms away. The separation from me has been traumatic for the children. They are in an unfamiliar environment and are not receiving their regular therapy and treatment. Their ongoing therapy and intervention are vital for the boys to achieve a level of independence and a better quality of life.
They were familiar with the therapies they were attending here at home which included Equine Therapy, Music Therapy (they were going to perform a special masterpiece they had practiced tirelessly for a year in a concert for the first time, which will not be possible if they live 400km), Tuition, Gymnastics-Ninja, Psychology, Occupational Therapy, friendship circles at school, and church.
The twins were not informed or transitioned for this change at all. I felt misled by the court that led me to believe that they were going for 1 week and changed it to a permanent order on the 6th day, leaving them with the other parent and a moratorium period of 2 months given to me. They were separated in the blink of an eye from the world they knew so well. They did not have their glasses, medication, sensory toys, or any of their important and special items, including their own toiletries and clothes.
This experience has been a nightmare, and I cannot emphasize enough how important it is for the children to maintain a routine they have known all their lives, which includes visiting their father and staying with their mother in their hometown where they were born and raised (as agreed upon by both parties 2 days before the final trial). I am here to protect the children’s rights as well as the parents' rights, ensuring that parental rights do not outweigh the children’s rights.
Both parents must learn to co-parent with respect, mutual regard, balance, and compassion for the children. The separation from a parent is traumatic for any child; however, for a child with the special needs mentioned above, it is not only a setback but could also be detrimental to their confidence, sense of security, trust, and may result in a regression of their development.
I need to lodge an appeal to share the custody of the children, and the estimated court cost is $30,000. I appreciate anyone who has the ability to assist me please. Donations received are utilized for the appeal court proceedings. Please help me bring justice to my family.”
Also feel free to pass the message on to your family and friends.
Thank you very kindly.
I had legal aid for the trial and the appeal will not be funded by legal aid. At the trial, once you have representation, you can’t speak and if you have bad representation, then it is a no win case, no matter what you do! In my case I had very poor representation. The justice system let me down. I have faced an unjust decision made by a judge known for extreme erroneous orders. Due to misrepresentation by legal aid, the truth was not brought to light in my case.
However, I have not lost hope. Through what I can only describe as a miracle, a kind barrister has offered his services pro bono for the first part of the appeal process, the notice of appeal, which alone costs $30,000. I was truly in awe and filled with gratitude and thank God for this unexpected Miraculous blessing! With 11 compelling reasons and more from this dedicated barrister, we are taking the necessary steps to appeal the judge's errors of law and fact.
But to proceed to the second part of actually filing the appeal, I am in need of your financial support of $30,000.
Your contributions will help me seek the justice I rightfully deserve. Every little bit counts, and I am humbly asking for your help in this crucial moment. Together, we can make a difference and ensure that the truth prevails.
Thank you for considering my plea and standing by my side in this fight for justice.
