My dad was recently detained by ICE after arriving for his petition to obtain legal permanent status (green card) at the immigration office in Philadelphia. We were reassured by his attorney, and mid-way through the interview, my dad was taken away abruptly in handcuffs. His final exclusion order was ordered by the judge 30 years ago, and in the current administration, ICE will detain anyone with this order regardless of the lack of criminal history in those 30 years. For the past year, we have been in contact with attorneys who have been aiding us in his case. We spent tens of thousands of dollars with his previous attorney, believing we were on the right path, but we were ultimately misled. It turns out my dad is not able to obtain a traditional habeas corpus, which is a judicial law that requires law enforcement to bring a prisoner before a judge to prove they have lawful authority to detain him—a right every person should have. Because of his legal status and a final exclusion order under the current government's immigration policies, he cannot access this right. Our new attorney informed us that as of January 2025, anyone applying for adjustment of status with a final exclusion order will be detained by ICE, which our previous attorney was completely unaware of. We are now represented by a new attorney who is seeking last resort options to help my dad. If this doesn't go well, my dad would be deported with nothing to his name to his origin country, which is no longer his home. This situation was completely abrupt for me and my family, and we are facing extreme emotional and financial hardship. My father is a kind man, who has no criminal record and has worked hard his entire life to provide for me, my younger brother, and grandmother. He is truly an amazing person and has single-handedly supported me and our family throughout our lives. Now that he is detained, we are just asking for help in order to aid in his next steps to move forward and find a solution to get him out of ICE custody.
