
Hardship Expenses for Rose Family- False Arrest

Hello. My name is William Rose. I have been Married for 32 years to my wife Lily, and we have twin boys who are 19, named Joshua Caleb and William David. My wife and I have served in lifelong ministry as Missionaries and Pastors as well as English as a Second Language Teachers, teaching low cost English Classes in Mexico and here in Tennessee to local Immigrants. I also delivered as an Uber Eats Driver for 3 years.
On October 26, 2022, our lives were turned upside down late that Wednesday evening. I had been in communication all day with my family by text and chat after teaching English classes earlier that morning. I had the responsibility that day of picking up my son Joshua from High School, taking him to work in Franklin, and taking my other son William David to Classes at MTSU University in Murfreesboro, Tennessee.
I dropped my sons off at work and college and started to make Uber Eats Food Deliveries around Murfreesboro while waiting for him to finish classes.
After making a delivery from Chick Fil A to a customer, it started to get dark so I decided to go wait for him at Chick Fil A. I was involved in a collision after turning on to a residential street after stopping. I waited for 2 hours for Police to arrive and take an accident report.
While waiting for them to arrive, I got out of my truck to put the Front bumper and bumper guard into my truck. I used Hand sanitizer to clean hands, but, I left my vehicle running as it was a cold damp day with the heat running and windows rolled up. My truck sustained tremendous damage to passenger side and front area.
After Police arrived, I was questioned for my Drivers License, Registration and Insurance by one of two police officers who then asked me if I had been drinking, to which I truthfully responded "No, I have not." They said my car was reeking with smell of alcohol. I explained it was Purell Hand Sanitizer and showed it to the officer. She then went to talk with other driver and another Police officer confronted me asking how many drinks I had consumed that evening, I explained again I had not been drinking, and that I do not drink Alcohol. I showed him the sanitizer and He said the same thing in response and asked me to step out to show him the damage to my vehicle. As I exited the vehicle, I was given Field Sobriety tests of the NSG Eye test, Walk and Turn on line and Right foot Balance tests
Due to ongoing medical issues with balance from Ataxia and Vision issues that have been diagnosed, I failed and was falsely arrested, handcuffed and charged with a DUI for a First Offense. I asked to take a Breathalyzer but was told they do not do breathalyzer, but, administer BAC or a Blood Alcohol test at the station. I pleaded with them as I explained I had not been drinking and that my son needed to be picked up from MTSU at 8 PM and was waiting for me. They called my wife in Brentwood to pick him up and my other son from work in Franklin.
The officers told me that I was going to be taken down to the station, Booked, Fingerprinted and Mugshot taken and formally charged with a DUI. I was detained for 8 hours, questioned, and released on Pre Trail Release at 3:30 AM the next morning and a court date scheduled for December 8th. I was immediately deactivated from Uber Eats due to a false charge of DUI and arrest and have never been able to drive for them again. I had to hire an a Criminal attorney to represent me and fight for my innocence as I was not drinking nor was I impaired. My speech was not slurred, I was coherent and my eyes were not bloodshot or glazed over.
This was and has been a nightmare for our family as we were not expecting to deal with this nightmare. I had not been drinking. I lost my income from my jobs for 3 months as an Uber Eats driver and all my English as a Second Language classes as a respected Teacher, was not able to drive. I suffered a damaged reputation as a Pastor and former Missionary, suffered tremendous emotional trauma in our family, and heavy Legal fees and Court appearances to fight this to prove my innocence over a year-long battle. Charges were finally dismissed after a year due to the BAC blood tests being 0.0% for Alcohol and Drugs and in my system which were drug out over a year by the local District Attorney and the TBI.
I currently am unable drive as My vehicle engine blew 3 months ago, and my Insurance rates and down payment are extremely high due to this being on my record previously and no one will insure me. This has presented a large hurdle to our family as we are still dealing with he effects of this case. We are trying to recover the following expenses accrued during this time:
$3500 for Lawyer/Legal Fees
$2300 Uber Transportation over 3 months for my family to work and school
$9000 in Lost Wages over 3 months
$2400 Car body repair from Accident
$1500 Insurance Down payment
$400 Impound fee on vehicle to recover my vehicle
$10,000 in approximate cost to purchase another vehicle for current transportation for my Family
