Tobyhanna Township For All Legal Support

Tobyhanna Township has passed an unenforceable, overly restricting, and unfounded legally ordinance. The specific sections below are what we believe to be against all justifiable reasons, and will 'not' solve the problems our community faces today.

  1. Section 8-A. - The STR Capacity Limit will be limited to two (2) per bedroom (...) but shall not exceed a total of ten (10) persons.

  2. Section 8-H. - A person in Charge must either reside (...) within a thirty (30) minute drive of the Rental Unit

  3. Section 8-B. - A person must be twenty-five (25) years of age to contractually rent a STR unit.

  4. Section 15-E. - Any person (...) permits a violation of the provisions of this chapter (...) pay a fine of not less than $1,000.00 nor more than $3,000.00 per violation

  5. Section 2-E. A subsequent STR Permit shall not issue (...) until the passage of ninety (90) days following any prior permit

If these items aren't changed to a less restrictive ordinance, similar to how neighboring townships Coolbaugh and Tunkhannock are currently restricted, we pledge to use these funds to hire legal assistance for affected STR owners of Tobyhanna based on the damages that would be inflicted with less reasonable regulations.

Should the ordinance be approved with the 4 above sections properly fixed we will continue to hold funds until a later date, effectively acting as a legal insurance fund. This fund will remain available for legal assistance should the ordinance be changed to an unfavorable and less reasonable regulatory document.

To date these funds have been used to hire legal experts, septic/construction experts to draft their opinions, and to create grassroots outreach efforts to bring in as many members of the community as possible so their voice can be heard.
