Friends of Cambushinnie Hill are looking to help support Braco & Greenloaning Community Council in a legal challenge (Judicial Review) against Perth & Kinross Council’s decision to approve the Cambushinnie Substation.
A legal challenge has been launched but the costs of doing this are significant.
Friends of Cambushinnie Hill has been set up as a platform to help raise funds for the Community Council.
Why we are asking for your support:
The Community Council believes the planning decision was made without proper consideration of the significant environmental and community impacts, including peat removal, landscape effects, construction traffic, and the haul road proposal.
Many in the community believe the substation has been sited in the wrong location, too close to homes, on peatland, and within a valued landscape, and that the decision does not reflect the community’s views or interests.
There is widespread concern locally that, if left unchallenged, this development could damage our rural environment, affect local amenity, and set a troubling precedent for future large‑scale infrastructure in the area.
A Judicial Review would allow the Court of Session to examine whether the decision was lawful, reasonable, and properly made.
Potential outcomes of the legal challenge include:
The court finding the decision unlawful, requiring the planning consent to be reconsidered.
SSEN being required to undertake a full and transparent Environmental Impact Assessment.
Better protections or alternative solutions being put in place for the community.
Or, if the court does not uphold the challenge, the community will at least have ensured that every reasonable step was taken to protect local interests.
What the legal challenge would cost:
The full cost of running a Judicial Review is estimated at £26,000 + VAT, though this may reduce slightly depending on the length of the hearing.
We are hoping to help raise up to £20,000 to help cover these costs.
Should there be any funds remaining following the conclusion of the legal challenge these will be donate to the community council to help support local initiatives.
